Judge Wylie stated that the bill was for an injunction. to re-train defendants from exercising’ ions as eflicers and employees of the fire department, and the pleadings show that defendants are in possession of the department by color of Ros 9 SF on what professes to be legal appointmen ‘The comp nts allege that inasmuch as they were appointed for good behavior the fire com- missioners had no right toremovethem. The authorities, as faras he had been able to ex- amine, are uniform—in one direction—andshow that in this case a Dill in equity will not lie.
