The deceased is about fifty years of age, & carpenter by trade, and bas a wife in Baltimore, where he resided until about four years ago. He was taken with a disease of ihe spine shortly before removing from Baltumore, and being unable to support bis wife in that city, bis brother removed Bim here, where, for over fifteen months, he was contined to bis bed, but he bas never since been je to work. About three weeks since be was obliged to retarn co bis bed, from which be never rose. On Monday last he asked his sister-in-iaw to let bim send for some powder and shot for her sons to celebrate Christmas with, bat she re- fused. Yesterday be talked very despondently, bat it was not thought that he was In any mao- wer deranged. This morning Mrs.Wain wright bsent about two hours from ber the deceased and ber children at id in a short time thereafter he called the oldest boy, aged about 14, and giving him a dollar, asked bir to get some powder, shot, and caps, which he did, and by direction of the deceased left them on a clair in the room, which he supposed was out of reach. He also asked for the pistols to load, and they were laid on the chair. The childres left the room. and about one hour after the re- port of the pistol was heard, and on the oldest boy entering the room he fonud that the chvir bad been drawn up close to bis uncle's cot, ma Toom on the ground floor, and thst bis uncle was dead, having dropped the pistol (a small single barrelled one,) with which the deed was done, ir the chamber chair, as also another smaller pistol. Holsien, tor keeping a Testavrant without lenses, came up before Justice Morsell fora hearing, when Mr. Hine, counsel for Hols:en, interposed a motion to dis- mise the case upon the ground that the sait purported to bave been brought munici- pal sovereignty to recover a to be due it from a private citizen, and the writ was not and did not appear to have been sued out by any officer nvthorized to institute saits on bepalf of the corporation.
