FURTHER contincance, The case of the parties arrested on Friday, on A warrant issued by Justice Walter, charg ‘hem With digging two ditches on First street, between K and M, in victation of law, was re- summed Lefora Justice Waiter in the Oriminal Court room yesterday afternoon afew minutes before four ovclock. The arraicaed parties were present: also, Lieut Eckloff and a squad of police, together with Commissioner Crane ‘and others interested for the prosecution, wo, with the counsel on both sides, composed & large crowd that nearly filled the court-room Mesers Leach, Norris, Totten, and Miller ap- peared as counsel for the defence, and Messt- Couk, Pearce, Burgess, and Walker were present for the prosecution. Messrs. Cox aud achanan, counsel on the part ef the Balti- more and Obio Railroad Company, were also iy attendance, bus took no part im the proceed- ings. Mayor Bowen was sent for as a witness, and remained im the court-room during the enure afternoon: but, as developed in the pro- ceedings, bis evidence was not admitted, Before proceedimg ia the case, Judge Leach desired to know who was on trial, and made a motion that the attorney for the Corporation be required to disclose under what statute the jaw had been violated. The whole matter was simply an accusation contained in an affi- davit sworn to by Mr. Crane thac one hundred avd filty men, whose names are unknown, were engaged in digging trenches of sach a depth on certain streets. There was no law which denominates this as an offence against the Corporation, and the attorney knew it. His Honor, the Justice, bad no jurisdiction mn the case, unless it was an offence against the statutory Jaw, and whatever miy be the offence sgamst the common Iaw we have only bere to contend against the provisions of the statutory iaw. Mr. Norris, also for defease, supported the Views of Judge Leach, amd asked that the case be dismissed. If an offense had been committ-d, as alleged, it Was not proper to hold the agent and employees responsible, but the Corporation sbould seek redress from the Baltimore and Obio Railroad. The case was nothing more than a persecution of the men employed—a myth, @ figment of the brain: for the warrant charged no offense, and there was no point of law which could @stablish the precedent that there was law ou the subject. He claimed that the charcer granted the Baltimore aud Onio Railroad Company did not define any partic: lar street for the construction of the road, denied also that the digging for the new track had done any damage to the street; bat, on the contrary, it had improved its condition. The Proceedings which had been instituted, he thought, were highly improper, and Barrassing toa setof men who Rad no interest whatever in ihe enterprise, and would work for any- ¥. Mr. Cook, for the prosecatton, said that if the counsel for the defense were there for the pur. pose of imploring light, they would have to Mr. Cook.—«I cannot be employed on both side: He then proceeded to reply to the po-nt of law urged py Mr. Nerris im deteuce of his appeal for a dismissal of the case, and said that if it was acted on atall, it could only be done as a demurrer to the indictment. Should this be the design of the opposing counsel to do so, he wished to be informed of it, and then he would know how to proceed. Mr. Norris.—+-Proceed as yon think proper.” Mr Cook.—+ Well, we'll proceed by calling our witnesses, and before We get through w the case we won't leave a grease spot on you. He then read the affidavit of Mr. Crane upon which the warrant was obtained, aud quoted from authorities of law, which he contended admitted fully the iegality of the proceedinzs of the prosecution and the terms of the afi ta. Having shown, therefore, as he content. ed, that the Warrant Was a proper and suifici- ent ore, the motion to dismiss could not bs eu. tertained util a thorough examiaation in tue case was gone into. Mr. Walker followed in support of the sam side. They bad no right to break the soil of spy street in the cily, and if they chose to do so they must suffer the consequence.
