That proof spirit shall be held and taken to be tnat alco- holic liquor which contains one-half its voi ume of alcohol of a specific gravity of seven thousand nine bundred and thirty-sine te thousandths (.7939) at sixty degrees Fabrent: and the Commissioner of Internal Revenue, for the prevention and detection of frauds by Gistillers of spirits, is hereby authorized to == and prescribe for use such hydrometers, saccharometers, weighing and gauging instru- ments, meters, or other means for ascertaining the quantity, gravity, and producing capacity of aby mash, wort, or beer used or to be used in the production of distilled spirits, and the strength and quantity of spirits subject to tax, as be may Geem necessary; and be may pre- scribe rules and regulations to secure a uni- form and correct system of inspection, weigh ing, marking, and gauging of spirits. And in all sales of spirits hereafter made, a gallon shall be taken to bea gallon of proof spirit, according to the foregoing standard set forth and declared for the inspection and gauging of spirits throughout the United States. And be it further enacted, That whet- ever the Commissioner of Intermal Rever shall adopt and prescribe for use any eters, OF meter safes, it shall be the duty of very OWneF, agent, or superintendent of s dis- tillery to furnish ard attach at his ownexpense such meter, meters, or meter safes xs may have been prescribed for use at his distillery, and to furnish all the pipes, materials, labor, and fa- cilities necessary to complete such attachment in accordance with the regulations of the Gom- missioner of Internal Revenue, who is hereby | further authorized to order and require such changes of or additions to distilling apparatus, connecting pipes, pumps, or cisterns, or any machinery connected with or used in or on the distillery premises, or may require to be put on any of the stills, tubs, cisterns, pipes, or other vessels, such fastenings, locks, or seals as he msy deem ni Ske. 4. And be st further enacted, That distilled *pirits, spirits, alcohol, and alceholic spirits, ‘within the true intent and meaning of this act, as that substance known as ethyl aicohol, hy- drated oxide of ethyl, or spirit of wine, which is commonly produced by the fermentation of erin, starch, molasses, or sugar, including ad dilutions and mixtures of this substance: and the tax shall attach to this substance as itis im existence as such, whether it sequently separated 8s pure or impure spiril, mediately, or at any subsequent time, transferred into any other substance, either in the process of original Production or by any subsequent process; and no mash, wort, or wash fit for distillation or the production of spirits or alcohol shall be made or fermented in any building or on any premises other than a distillery duly authorized according to law; and no mash, wort, or wash so made and fer- mented shall be sold or remove from any dis- tillery before being distilled; and no person other than an authorized distiller shall by dis- lllation, or by any other process, se; the alcoholic spirits from any fermented mash, wort, or wash; and no person shall use spirits or alcohol or any vapor of alcoholic spirits in manufacturing Vinegar or any other article, or im any process of manufacture whatever, un- less the spirits or alcohol so used shall have been produced in an authorized distillery and the tax thereon paid. Any person who shall violate any of the provisions of this section, shall be fined, for every offenc, not less than five hundred dollars nor more than five thou. sand dollars, and imprisoned for not less than six months nor more than two years: Pro. vided, That nothing in this section shali be con- strued to apply tofermented liquors. Sec. 5. And be it further enacted, Thatevery person having in his ion of custody, or under his control, any still or distilling appa- ratus set up, shall register the same with the aseistant assessor of the division in which said still or distilling apparatus shall be, by filing ‘with him duplicate a im writing, sub- ticular piace where such still'oF distilling ap- tus is set up, the kind of still and its cu- ic contents, the Owner thereof, his place of residence, and the purpose for which said still or distilling apparatus has been or is intended to be used; one of which statements shall be re- tained and preserved by the assistant assessor and the other transmited to the assessor of the district, Sulls and aistilling apparatas now set up shall be so registered within sixty days from the time this act takes effect, and those bereafter set up shall be so registered immedi- ately upon their being set up. Any still or disthisag mame not so registered. together with all personal roperty in the possession, or custody, or under control of such per- sons and found in the building, orinany yard orenclosure connected with the building, in which the same shall be set up, shall be for- feited.
