Witness arrested the prisoner, and about one hour after searched him, finding some caps and a ball. Mr. John J. Peabedy,s worn.— Witness is a gun- smitb; was present at the coroner's inquest; examined some pieces of lead; held the same opinion now, ¢ ¢., that the pieces of lead were originally round and about the same size as the round ball; but would not be positive. The three went to the Licbau House, on Louisiana avenue, near 6th street, where he saw among others Mr. Hinton or Linton and another gentleman with sandy whiskers: remained abeut !5 minutes first, when Witness and deceased went ont; while there K. called for drinks and witness advised him to drink light, as be was pretty drank; Hinton, the accused, witness, and others drank: the prisoner was drank; K. remarked that he had challenged Turptn’s vote two or three years previously, when Easby was running for Mayor. Turpin denied it, saying no one he deceased then commenced smnging “ Lanigan’s Boll,” K. had made the assertion previously on street. Deceased did not sing more than two lines im the song when he spoke about a drink. Witness advised them to drink light, and asked for “Gallagher” a ginger pop, thinks alldrank light. Torpin went back, and wit- wess, with deceased, went out, but retarned in about five minutes, when he found in front ‘Messrs. Lloyd and Hinton and the gentleman with sandy whiskers (Frazier) and Mr. Tur- pin, who was sitting on a broken lamp post or tump. Mr. Lioyd invited the whole party m to drink if they would take pop. They all went and the accused hesitated, and he pulled out & pistol, eayicg that some one had threatened to kill Bim on the previous might. The pistol was one which he bad always understood to be a Derringer, (rifled barrel.) He said some one in the Northern Liberties bad threatened to in him, and hewas going to get even that night.
