John Freeland testified that they had some words about a steak, when Carroll struck O'Neil and they clinched, when Carroll put his hands to his abdomen saying he was cut. Jas. Nalley corroborated this testimony. Wm. Langley testified that Qarroll caught O'Nei' witn one hand by the shoulder and struck him ‘with the other. Mr. Norris contended that the case was clearly one of self-detence, and even if the wound re- suited in immediately, the Justice would be warranted in dismissing the accused, and he would move his discharge. Justice Lynch said that he could have nsed somie other ‘instrument in defence, and he felt committed to hold him to bail for court.
