We referred yesterday to the pending mvyesti- gation in the Baltimore City Council of charges ef corruption made against members of that body. The special committee which was ap- pointed under a resolution of the City Council of the 15th ultimo, “to inquire into certain re- ports implicating the integrity of the present City Council, connected with the pasaage of the | resolution for the further endorsement of the | Westerti Maryland railroad bonds by the city,” | after investigation and taking of testimony, (ntinding among other witnesses ex-Mayor Cbapmian, ‘late President of the Western | & Maryland Railroad.) made their report yester- | day, and submitted a resolution, “That whereas | James Bullock, Jacob Oster, and Thomas J. A reso. | jntion was also passed authorizing the same | committee to investigate as to the party or par- | ties who may have offered bribes. ‘The.action of the Councils in thus promptly punishing, so far as they can, the delinquent members, who belong to the same political party as the majority, is commendable; but the | matter will not probably rest there. There | was a provision of the new consiitution which required the Legislature, at its first session after the adoption of the constitution, to pro- vide by Iaw fur the punishment, by fine or im- prisopment ir the penitentiary, or both, in the diseretion of the court, of any person who shall bribe, or attempt to bribe, any executive or ju- dicial officers, or members or officers of the Legisiature, or of any municipal corporation, and for the like punishment of the officials above mentioned who shall demand or receive any such bribe, and for compelling any person bribing or attemptmg to bribe, or demanding or receiving a “bribe, fee, reward, or testimo- nial,” to testify against any person who may have committed any of these offences; provided that the person so compelled to testify shall be exempted from punishment for the offence, and declaring that any person convicted of these ‘offences shall be forever disqualified from hold- ing any office of trust or profit im the State ‘The Legisiature passed a law in accordance ‘with this provision at its late session, and pro- crevings will probably be taken wader it in these cases. In ad- dition to 55 annual conferences there have been | organized £3 mission conferences, 11 of which | have sent delegates to. We see, then, that according to the case made im the eighth articles, the udent did not succed in getting Mr. Stanton out of office, or porting Gen. Thomas in, either im law or fact. ‘There bas been, according to the very case made in these hepa no misebief. There has beeu no removal of Mr. Staton, only an abortive attempt at removal. No ad interim officer has, in law or fact, been constituted, tor there has been no interim as to the Secretary himself. Then the acts, charged as high crimes and mis- demeanors in —-> putting Mr. Smaoton out and Gen. Thomas in are things attempted, and not things accomplished. These all high crimes and misdemeanors are all founded upon mere forms of executive administration, for the violation of certain rules to regulate the conduct of the Executive Department. It applies equelly to officers whose tenure of office, as fixed prior to the act, was to bold during the pleasure of the President, as to those who were to hold tor a fixed term of years or during good behavior. 3d. It purports to take from the President the power to remove any officer. at anytime, for Any cause. by the exercise of his own power alone, but it leaves him a power of removal with the coneurrence of the Senate. In this Process of removal the separate action of the President and Senate is required. The in- iwatory act must come from the President, and from him alone. Thus far the first clause of the first section of the act, without reference to the contest, seems to have a universal applica. tion to all civil officers, snd to secure all of those who hold by the concurrent action of the President and the Senate, st removal, otherwise than by the same urtent action, and tomake all of them liable to removal by that concurrent action. ‘There are, however, exceptions to the uni- versality of the tenure-ot-office thas declared: Ist. exceptions by necessary implica dicial officers of the United § ure is fixed by the constitution itself, 2d, ex. ceptions made expressly by the provision: of the act. This purpose is indicated by” the title ofthe act, which ts: “An act regulating the tenure of certain civil offices, and not of all civil offices.” What class of officers embraced by the general provisions of the first clause are made to come within the clanse of the ex tion!
