He said the iron-clad oath for office in the constitution was extreme- ly objectionable. He had administered the re- construction laws in the State more than a year, and stated as the result of his experience that it would be impossible to carry on the goverament of Virginia on such a basis. In appointing registering officers, he had found one, perhaps two, capable men in a county who could take this onth, and yet there were thirty civil officers in these counties. In his cpinion, the oath would be fatal to the consti- tution. Much depended on the men first elect- ed tocarry it ont, and that oath restricted om Tange necessary for the selection of the men. The Cabinet meeting oa Friday, February 21, was held at 12 o’clock; had a con- yersation with the President that day at 2 o'clock relative to the removal of Mr. Stanton; witness bad not, up to thst time, any knowl- edge of Mr. Stanton’s removal; the iuterview | took place after the adjournment of the Cabi- | net meeting. The President, on the occasion | referred to, did not make a communication to | bim im reference to the removal of Mr. Stan- ton and the appointment of General Thomas. ‘The Cabinet had got through with their busi- ness, and were about separating at the time, All the members were present except Mr. Stanbery. Mr. Evarts now said they offered to prove that the President communicated to his Cabinet on this occasion, before the meeting broke up, that he had removed Mr. Stanton and appoint- ed General Thomas Secretary ad iaterim, that | Mr. Welles asked it General Thomas was in possession. The President replied that he was; And upon further question of Mr. Welles, the President replied thet Mr. Stanton acauiesced, and all that he required was time to move his papers. Pilir. Butler said the managers did not wish this should be received as evidence. It was now made certain that the President had at- tempted the remeval of Mr. Stanton without any consultation with his Cabinet. Next, he (Mr. B.) contended that the President had no Hight to tnke the advice of bis Cabinet officers, cept in writmg. Mr. Evarts said that nothing had been said by the witness to prove that the removal of Mr. Stanton determined upon before the advice of the Cabinet was taken upon the sub- ect. Mr. Welles had only said that he had not eurd of it before. They proposed to show that the matter was mentioned by the President to bis Cabinet before their deliberations were (broken up, and the advice and questions of his ‘abinet as to the posture of the affiir. Mr. Curtis said they did not place their ap- plication on the point that it was the advice of the Cabinet to the President, but that it was the cflicial act of the President m making this communication to his counsellors. Mr. Curtis id that the practice of Gen. Washington and John Adsms bad been te call their Cabinet to- gether in ¢ = thi nueil to take their advice, and that custom of Mr. Jefferson also to take Cabinet on any subject, and elaim- himself, and if his Cabinet did not agree with him he also reserved the power w ¢ trule their determination, and this he (Mr.€.) understood bad been the practice of the Government from that day to this.
