This rale stood orginally as follows: “The ‘iding officer of the Senate shall di- Teet ait nee = preparations in the Senate Chamber, and the presiding officer upon the trial shall direct all the forms of proceeding hile the Senate are sitting for the purpose of a impeachment and all forms during i not otherwise specially provided for The presiding officer ma: irst instance, submit to the Senate, without a Gtvision, all questions of evidence and incidental questions, but the same shall, on the demand of one-fifth of the members present, be decided by yeas and nays.” The rule as modified reads thus : “The presiding officer of the Senate shall di- rect all bengeen eB pest erenemgs in the Senate Chamber, and presiding offlcer upon the trial shall direct all the forms of, proceeding while the Senate are sitting for the purpose of trying an impeachment and all forms during the trial not otherwise specially provided for, and the presiding officer on the trial may rule all questions of evidence and incidental ques- tions, which ruling shall stand as the judgment of the Senate unless some member of the Sen- ate shall ask that a formal vote be taken there- on, in which case it shall be submitted to the Senate for a decision,or he may at his option, in the first instaner, submit any such question wo | @ yote of the Senate. There is some disposition to look upon this | B action of the Senate in a partisan light, and to | claim that it ig’n defeat for one side and a yic- | tory for the ether. It can hardly, however, be made to bear that construction. It gives to the | Chief Justice the power to rule all questions of evidence and incidental questions, but re- serves tothe Senate the right to overrule his decisions. Its effect will be to shorten the trial by avoiding the delay of a vote upon the thou- sand and one questions likely to come up for | decision in the course of the trial.
