Shepard, a citizen ofthat State. It will be recollected that the homicide grew outof an acrimonious corre- spondence between Schaff and Shepard, which ended in (he latter challenging the former to ficbt aduel. Scbaff had Shepard arrested and brought within the arsenal, and, it 1s alleged, instantly shot him, the ball taking effect in tne eck. Shepard lingered some days and died. In the meantime, Schaff was tried before a court-martial for conduct unbecoming an offi- cer and found guilty. These proceedings Will be annulled, and the trial for murder go on.
