Recollects nothing of bis dress but that he wore a large shawl, covering his body to the waist. He had then a very lizhtmoustache and goatee, light in quantity. David C. Robinson sworn aud examined by Mr. Bradiey.— Witness resides at Elmira, New York. Knows the Brainard Hotel; kept the most of April, 1665. by Granby and Walker. Witness bad made diligent search for the reg- istert of the hotel, but had been unable to daigua from Elm'ra. Objected to, and objection sustained. Judge Fisher said the question could be pu ‘as to what time persons arrived in the regular course of business. but the witness could not refer to the register. Witness resumed.—One trrin arrived at Ca- nandsigua from Elmira in the forenoon, be- tween 10 and 11 o’clock,and another in theeve ming, between9 and 10 o'clock. Witness deliv- ered the book to Mr. Chamberlain on the 22d of April. when he took possession of the house, The night or check book was here shown 00 Witness, and be testified the leaves were torn out between April 12th and 20th. Entries on the 1th were there, and entries of the 20th. The books were removed to a wood-shed chamber, and the children often went up there to play school, and they might have destroyed the leaves. The book was found by the son of ‘witness, but the missing leaves could not be found.
