S@ For “AucTION SALgs", advertisements wee fourth page of to-day's Srag. LOCAL NEWS. Habeas Cerpus Case. This morning, Warden Brown, of the jai bad before Judge Wylie George W. Hovk on awrit of habeas us. he having been committed to bis custody about three weeks Bince by Justice Clayton on the charge of lar- ceny in Cbarieston, S. O., by abstracting $10,000 from the satchel of Major Hixon, pay- master U. S. Army. The application was made for his release by H. O. ding, Esq., bis counsel. Paymaster Hizon wassworn, and testified that the money was lost by him in Charleston, S. C., about four months since, at which time he Was stopping at a house adjoiming the Plant- er’s Hotel. The money belonged to the Goy- ernment, and amounted to $10,000. The'Plant- er’s Hotel was not open, having been pre- Niously closed, and the prisoner employed there as a night watchman. Witness drew the money on the ist of March from the Treasury, about 2% o’cleck in the afternoon. Took it immediately to the house befere mentioned, ‘nd placed it in asatchel. At 8 o’ctock that Right witness leit for Savannah on the steam- ‘boat. A colored boy carried witness’ satchel trom the Louse to the boat, and into the cabin. when witness took it and placed it im bis state-room, On arriving at Savannah next morning, and opening the satchel witness discovered that & package con- taining the amount was missing. Immediate- ly came beck to Charleston and employed a detective officer to work up the case. Witness had opened the satchel before leaving hisroom at Charleston to place some things in it, bat bad not discovered anything wrong. The lock ‘was not broken nor disturbed. Witness did Ot remain in the room all time between plac- ing the money in the satchel and the time of @epartare tor Savannah. Knew the prisoner Saw him just before jonving, for Savannah. As witness was going out of the door with the colored boy to the boat saw the prisoner Standing near by. He asked witness if be was going away that night; witness replied that he was, and the prponer said he was also going away that night for the north; witness then turned around and bade him good bye: cannot state but that the money may have been stolen while on the trip to Savannah; ‘witness never heard anything against the pris- oner; knew him casnally as an employee at the Planter’s Hotel, where the witness used frequently to stop when it was open to the public: the prisoner knew that witness had drawn the money, as he had seen witness ‘with it: had not drank anything that day. _Leeman Bonnell.—Witness is a detective Knows the prisoner. He was brought on here by a Deputy Marshal from New York about three weeks ago. His home has been in Wille- mantic and his trunk is now in Yantic, Connecticut. When this money was stolen Tisoner wasa porter at a hetel in Charleston. he reason why he has been kept in jail so jong is that when arrested he expre’ a willingness to go back South: witness wa- en- gaged so busily in following up clues as to the recovery of the money that he neglected to send jor a requisition and did not think he should have to do so, in view of the promise of the prisoner that be would go without it. Witness ‘was engaged longer than he expected to be in following up the clues, and when he came back here to take the prisoner South, he found that a writ of habeas corpus bad been applied for by the prisoner. to be discharged from cus- tody. Witness’ name is Bonnell, but he had Assumed the name of Black fora few days; is a detective, of Savannah, Ga., and is working this case by authority of the War Department. Mr. Gooding argued that no evidence had been produced to connect the prisoner with this larceny, and his conduct was such as to show his innocence. It was true that there migbt be some grounds for suspicion, but any person who was in Savannah that nignt was Jiable to the same surplickins. Judge Wylie said that it seemed the accused ‘was arrested on the oath of Mr. Bonnell, and it-was presumed that he had goods grounds for Making th2 charge. The failure of a requisition mot having been made is satisfactorily ac- counted for, he having expressed a willing- ess to go South. Mr. B. should, however, re- member that even if he had started with the prisoner he had no security for him, and he could havernn off at any time. In this Mr. Bonnell had been negligent. The ends of jus- tice require that the prisoner should be re- ‘Thanded to await a requisition, and he maae an order to that effect, saying two weeks ‘would be allowed to procur requisition. ——_s—__.
