NatIoNaAL | HBATRR.-The Richings English Opera Troupe in “The Euchantress” this evening. —_o—_—_ SamroRD CONOVER.—Yesterday afternoon, the appeal from (be judgment of the Criminal Cour’, (Judge Fisher,) in the case of Sanford Conover, alias Charles A. Dunham, convicted of perjury in connection with tne assassina- Lon mMvVestigation, and who was sentenced to te years’ imprisonment in the Aibapy coaaty penitentiary, was heard in the Supreme Couit. The execurion of the sentence was suspended, it will be reme:nbered, until the first of June, At the instance of Conoyer’s counsel, Juage Lander ana Mr H.C. Gooding. The defense submitted the point that Con- @ver wus tried under the statute of 1925, which ‘W4s & generai statute, applicable to the United States at jarge, and which prescribed a pen- alty of not more than five years’ imprisonment, and that be was sentenced undera different statute—thar of 1831—which was applicible only to the Dis rictof Columbia, and which prescribed a_ penalty of ten years’ im- pri-onment. They contended that the sen- tence was illegal, as he should have been sentenced im accordance with the statute under which he was convicted. They also claim that by the law abolishing tne penitentiary in tke District of Columbia, the Secretary of the Interior was required to designate, on the first day of e:ch term of the court, the prisons to whick convicts from this District should be sent; that the Seeretary of the Interior had not complied with the letter of the law, except in 1863, when he-desiqnated the prisen at Albany. 1t was contended that asthe Secretary had failed to designate the priscu as preccribed by Jaw, the court pos- sessed no power to designate one for itcelf, but that, éven ifthe conrt holds that tne letter of the Secretary, written in 1863, war stl in terce, the sentence of Conover had not con- formed. to it; for the letior designated. the “prisom at Albany, New. York,” while the court sentenced Conover to be impriconed in «the Albany County Penitentiary:” and it Was argued that there was a recognized dis- tinction between.a prison anda peni entiary, And that the Jetter of the law should have been complied with.
