Hadjhe been tried and convicted of perjury in direct connection with his texti- mony before the military commission, 1t would have fared much werse with him. He was tried and convicted under a general statute and was sentenced under a special statute baving relation to the erime of perjury in the District of Columbia, and his sent-nce is to suffer the fell penalty prescribed. The court does not meet in banc for some weeks yet. and, in the meantime, Conover will probably be sent to: Albany, as Judge Fisher intimated that it did not matter mucb whether he was in the jail or in the peniten‘iary: for even in the event of the ap- peal being sustained by the eourt in banc, he would <till have a penitentiary sentence to fulfil.
