Under this view of the case, should the Sen- ate adjourn without confirming appointments to fill vacancies existing at the time the law Was passed, the President can at once make appointments to fill them. It, as does the Mississippi petition, arraigns Con- gress, and contends (hat the act “for the more efficient government of the rebel States” do-s in effect abolish the present State government of Georgia,and confers suffrage on the African race pot provided fer in her_ constitution, while excluding loyal whites. It sets up the plea of unconstitutionality of taxing the State without allowing her representation in Von- gress. and as the President of the United States, the Secretary of War, General Grant. and Major General Pope are the instruments to puc tbe acts of Congress into operation, thus overthrowing the Government of Georgia, the complainant asks that they be restrained from so doing. They ask this in consideration of the premises. that she has no remedy at law | OF any other effec:ual remedy whatever. The petition is signed by Jeremiah S, Black, solicitor for the complainant, and by Jere- miah S. Biack. Robert J. Brent, Edgar Cowan. and Charles O'Conor, of counsel. THE MARYLAND ELRCTION.—The result ot the election in Baltimore yesterday may be briefly stated as follows: For State eonstitu- tional convention, 11.016: against, 913. A majority for the convention of 1.593. For Sunday cars, 10,939; against, 9,065. A majority The total vote cast in the city was 2,139 on the convention, and 19,995 on the car question. Sumner said he understood opinions had been given which went far to nullify the recent act of Congress. 1t would thus seem we have nullification here in Washington, in the Executive branch of the Government. He understood that, according to these opinions, the President was to exercise the wer of appointment during the recess of Congres: notwithstauding a recent act of Congress, which undertook to regulate the tenure of office. Now they all knew the astuteness of & coach and six through the recent act of Con- gress; in other words, that it was about to force on the country officers who cannot be officers under the existing law. It seemed to him important that before the Senate adjourned they should know the precise state of the question. They should understand whether apy such opinien bad been given, and the Teasons for it.
