Haveas Conrus Case.—Yesterday morning, sa Chambers, Lewis Smackam appeared be-~ ore Judge Wyhe, having im charge two col- ored boys, Rebert and Lewis Wilkins,on a writ of habeas corpus eued out by Mr. Gren bury M. Watkins, of Montgomery county, Mad. Mr, J. WH. Bradley, jr. appearing for tue petiuoner, and Messrs. Browgaad Smithers for <be respondent. The petition im the case set forth that the children were the issue of a slave woman, ‘Crissy, who subsequently was the wife of the respondent. and were indentured apprentices to him (Mr. Watkins), having been bound to bim pa the Orphans’ Court of Montgo' county,in December, 1865; that they have lived ‘with bim until few weeks since, when be gave (bem permission to visit their uacle in Georgetown, and they had not retarned. The respondent (Smackam) in his answer states thar be is the step. father of the children, wio are issue of Bis former wife, Crisey, and charges that the petitioner treatea them ‘be adly, sseris that they wished te remain with the respondent. Uousiderabte testimony was taken im the case on both sides, including a cer*itled copy of indentnres from the Montgomery County Orpbans’ Court. Mr. Browne read a portion cf the civil rights bill, and said that it nullified the Maryland law. The term used im the indentures 1s ‘master,’ a term which is one of the relics of barbariem The Court said that unless authority was wh to prevent @ court from binding ont ite and black children, he should have to espect the Mon.gomery County Orphans’ € court. The laws of Congress do not say that ~ bite children should net be bound out, and n the eye of the Inw white and black are on an. yual footing. In this case the children are without father or mother: they were bound Mr. Watkins by the court in the terms of law. and he is to treat them well.
