Carrington, ar- guing in favor of the demurrer to the indict- Tents the case of Conover, indicted tor per- jury. te claimed that there were three depar ments of the Government—the executive, legis- Intive, avd judicial—and proceeded to quote Story on the Constitution to show that it was the imtention of the founders of the Govern- ment that (bese departments should be kept separate. He contended tt at che Congress onal committee bad no right to make this inquiry, and that they bad usurped the powers ot the Judiciary. and their investigation of the sub- ject was an impatation that the executive and judiciary were derelict in their duty. The very resolution reported by this committee shows that the Inquiry was not necessary. Whether the parties were guilty or not, wouid not warrant any legisiation. The courts were open to try the persons alluded to, and it was in the power of this court to try them. The highest erimes of which they could be convicted would be murder or treason, and it was in the power of the court to try these. He did not deny that the Congress of the United States bad the power to investigate the conduct of any officer. but did deny that they had the power to make a judicial investigation. The courts were not the creature of the legislative branch, but of the Constitution. Mr. G. read from Ethott’s Debates, vol. 5, page 345, what Was said by Madison as tothe danger of the legisiative usurping the power of the other branches of the Government. He argued the Gepositions would not support the charge ot perjury, ard read from Archibald, vol. 2, page 965; Russell on Crimes, vol. 2, page 441. and said where depositions were not irregularly taken, and not admissible as evidence, they would not support the charge of perjary. The ac- cu had contradicted a part only of Hoare’s testimony, and he was so understood by the comm and the indietment shonld state What part was contradicted and what was not. Brown and Jobn Hart boys of 13 and 15 years, have beeo arrested by officer Howard, of the Seventh Ward, for the jarceny of sundry articles of small value, the property of John Keyworth. They were taken before Justice Morsell, and sent to jail for court. Robert Fisber, colored, was arrested by of- ficer Ellis, of the Third Ward, for petty lar- ceny of meat, the property of Wm Hess. Jus- tice Thompson sent him to jail for court. Edward Hoover was arrested by officer Mel- sop, of the Seventh Ward, as an accomplice in the larceny of the barrel of syrup from Thos. M. Cassell, mentioned in the Star Thursday. Justice Handy held bim to bail tor court. Emapuel Werner was arrested by officer Parker, of the Seventh Ward, for the larcen of various articles of harness, belonging to T. T.Fowier. The articles were sold to W. B. Mille, who keeps a junk shop. Werner was sent to jail for court for the larceny, and Mills was held to bail for court for buying the goods by Justice Handy. Timothy . James Crokes, and Andrew Browman were arrested by officer Pool, of the 2d preeinct, for the larceny of a chain and col- lar. Justice Waiter sent them to jail for court. Senet Decree or Divorce.—Thursday, Chief Jus- tice Oartter, sitting in the Equity Court, made @ decree divorcing Susan Silence from the bonds of matrimony with Wm. Silence, giving the complainant the guardianship and custoay of ber child, with the household furniture and effects. The petition, filed May 10th last, sets forth that the parties were married in Mont- gomerycounty, Md. in May, 1851, and that they lived together as hus! and wife in this District urtil September, 1865; that prevons to deserting her he kicked her and attempted to beat ber, and she had him arrested. She charges that nearly the whole period of their married life be bas been idle. intemperate, and unthnfty; that be frequently tantalized her by telling her he bad a Jersey girl; that he has been guuity of tery in a house on 1344 street, in March, 164, and with 8 woman named Kessiey, at the Nanonal Hotel, in 1865. The respondent flied bis answer May 3, in which he denied the allegations set Yorth by the petitioner. The evidence in this case, whieh is quite volumi- nous, was taken before Commissioner E. F. Brown. Tt aS A New BUILpinG ASsOCIATION.—A new building association was organized on Thurs- day evening at Dooley’s Hall, (Capitol Hill.) at which there wasalarge attendance of the substanwal citizens of the Fifth and Sixth Wards. After the adoption of a constitution, the following officers were elected :—| mt, ol. James A. Tait; Vice President, Dr. C. M. Ford; Treasurer, Geo. F. Gulick; Seeretary, W.T. Johnson, Directors, J. M. Dalton, W. J. Wheatley, W. M. Berry, J.M. Shomo, John Morris, N. B. Mead, J. S. Slater, Chas. Halse, and Joreph Fry.
