Barch on the charge of having been disorderly about the neighbor. hood snd in bis bar-room, and attempted to wonke the arrest there. Burch demied that the officer had a right to arrest him. A scuifle en- sued between them,and the officer Raving a Jame band got worsted, and was beat out of the horse. Subsequently Birch, in the front of his house, cursed the police, and Sergeant Franktip. with officers Mark wood, Clements and others, happening to pass by, took bim in custody, and carried him to the station on the charge of being disorderly. Yesterday after- noon, the case was calied up befere Justice Walter. when Westfield testified that Birch had been disorderiy during the day, and in the afternoon, bearing a noisé in Bircb"s house, he ‘went over and looked in. B. asked him to take a Grink, which he declined, and he (Birch) called witness a Dutch s—n ot ab—b. West. field told bim to consider bimself uader arrest, an@ put his hands on bim. Burch rep ted that ‘witfiess bad no right to take bim, and struck him. The witness then used his baton, and they clinched, falling um the floor.
