The foregomg decree bas no application to those vessels which would be subject to deten- Hon and capture even if they were neutrals. This, my decree, shall be published in the eoliection of the laws. As supplements to this royal decree, the fol- Jowing ministerial order of the 2ist June, of the present year, has been issued. By royal ordinance of the 12th June, 1956, the Geciarations signed in Paris on the 16th April, i8S6, on the privileges of maritime rights is proved, and it is ordered: That privateering is abolished. ‘That the neutral flag covers enemy's goods, with the exception of contraband of war. __ That neutral property under the enemy's flag, with exceptions of contraband of war, shall not be subject to seizure. That blockades to be obligatory must be ef- fective, tbat is, sustained by sufficient arma- ment toprevent the approach to the coast of the enemy It 1s further ordered by the royal decree of the teh of preeeding month, that, on the condition of reciprocity, merchant ships belonging to subjects of hostile es shall not be liabie to detention and capture, with the exception of easesin which even neutral ships would be subject thereto; and further, this deliverance of vessels from detention and capture releases also the cargo from seizure, as stated in the Staats avzeiger No. 141, among the public decrees, announced to the elders of trade at Dantzic. The imperial Austrian Government adheres te those who take part in the declaration of the 36th April, 1856, and Bs also made known that on her part, in consideration of reciprocity, she also boids the goons oe set forth in the Yeyal decree of the 19th May. The preceding orders are, therefore, fully applicable to Austria during the war. Therefore, in respect of the relations of nay- Jgation at this time, we have only to state the following : 1. Austrian merchant vessels which are now im Prussian ports, or whose masters, unaware of the breaking out of the war, may enter Pruseian ports, shall, on condition of recipro- city, Dave six weeks, reckoned from the day of ‘ry inte port, to land their cergo, and to go ‘way with & new cargo, contraband of war excepted. On the expiration of this term they most eave port. Austrian merchant vessels, whose masters were aware of the breaking out of the war, are not permitved to enter a Prussian port. On the part of Austria there is the Impe- Tui) Mandate of May 15, of this year, which de- crees as follows: With reference to the declaration of the Pow- ers assembled at the Peace Congress in Paris on the 16th April, 1556, whereby international principles were agreed upon for the abolition of privateering, and in regard to the richts of neutrals, which had for purpose to mitigate, as far as practicable. the injuriously enhanced action of war upon maritime commerce,through the uncertaimty of public law, and in view of extending the working of this purpose, so far as depends upon Austria, on the guaranty of reciprocity— 1 resolve, after hearing my council of Minis- ters, to decree Article 1. Merchant vessels and their lading may not, on the ground that they belong toa country with which Austria is at war, be de- tamed at sea by Austrian vessels of war, nor be declared good prize by Austrian prize courts: Provided the hostile power observes reciproc- ity toward Austrian merchant vessels. The observance of reciprocity will be pre- sumed until notice of the contrary is received, while equally favorable treatment is extended to Austrian merchant vessels on the part of the hostile power, either in accordance with the settled principles of its legislation, or guar- anteed by their explanations at the commence- ment of hostilities. The capture and condemnation of merchant vessels of a hostile nation, by sbipsof war of this kingdom, is abolished, on condition of reciprocai action by such nation ordering like treatment in favor of the mer- chant marineofthiscountry. This reciprocity moust be ratified by local laws, diplomatie agreements. or explanations which the hostile Power has given at the commencement of hos- thes. Article 212.
