ASSAULTING A LANDLADY.—This morning, Justice Walter had before him. John Heller who had been arrested by Officer onthe eb: ofan assault and battery with intent 10 kill isa Zimmer. The evidence was to the effect that Helier rented a house from the com- plaimant whois hissister, and that several days ago she supposing that he was abcu’ to move out being arrears for rent, went ia to demand payment and threatened to lock the house up, when be grabbed her by the throat, and when his wife and daughter interfered he released her. It was argued by Mr. Phillips, who ap- Pe red for the prosecution, that the rent hay- ing become due previous to the date of the oc- currence, she had a right to enter the place and demand the rent and that the assault could not be justified. The Justice took the view that had the rent become due on the day in ques- tion, the prosecutor’s husband should fave acted in the matter, and that to accomplish her object a distrain warrant should have been obtained. She not having entered the house legally and haying threatened to lock the doors provoked theassault.
