He said he wanted to get a place on along boat, and get out of danger as he hag killed aman. He wanted to geton the boat with uncle George Williams. Witness did not ask him abont killing the man, or what man it was. Witness did not believe what he said. This witness haying concluded, an officer was sent tosummon Mary Washington, wife of the witness. In the meantime a conyersa- ton was going on aboat the doubts at first entertained, when an elderly colored man named Thomas Powell entered, and hearin; & doubt expressed, remarked alond, “Why, know that’s the man!” Justice Thompson— bat do you know about it? were you there '" Russell—-No, sir; but this man ina © be did it: and was trying to get away. Rus- sell was sworn, and testified that soon after the affsir, and while the officers were looking for the man, “This man, the prisoner. He is the man, and nother! came to me and told me he did it. and was trying to get away, the © police was after him. He spoke in earnest.” Witness believed him, and went to find the officers, but before he found them this prisoner gotaway Mary Washington. colored, was sworn, tes- tified that she had known the prisoner from a child. He came trom Virginia and belonged to widow Fitzhugh’s estate. it winter, at night, it being cold, and witness's supply of wood having run out,she locked the door of her house, leaving the children, and went to get some wood. When she returned she found the prisoner sitting in the house with the children. She scoliied her daughter for letting bim in. She bad not seem him for along time. He sat there tesling about Rhode Island and the army. Witness did not know of the death of the boy Simonds, but beard of it afterwards, and also that the prisoner killed him. And about a cou- ple of days afterwards met bim again, and told bim she bad heard that he had shot a boy named George Simonds. He replied that he did, but it was all right. He bad given ared head white girl named Hell thirty or forty dollars to swear tor Bim, and the jury brought in a verdict of elf defense. He said the boy attacked him with @ razor and he shot him. Justice Thompson committed the prisoner to aul for court. 7 Tux InvEsTIGATION.—Yesterday afternoon’ at the request of Superintendent Richards and Patrolman J. B. Wilson, Justice Morsell, in- vestigated the circumstances of the shooting of Kobert Floyd, colored, by Patrolman Wilson yesterday morning. The investigation was held at the Central Gaardhouse. Mr. J. J. Shuman testified that he resides in i2th, near M street, and yesterday morning beard a shot,and knowing that the officers were killing dogs went out. Saw the colored man with his shirt opem and blood trickling su his nose was bleeding; went toward bim and the man advanced toward witness; as he approached the man dropped on one knee; witness went to him and saw he was woum |. The officer had got to him before witness and tried to get him toa house. The man said be could not walk and fell. The offi- cer asked for & doctor. and witness sent a little boy for Dr. Smith. The officer got a pitcher of water which he poured on the man’s head. The man was out of theofficer’ssight when the shot was fired. The distance from the lineo the fence, on M street, to where the man wa shot, on 12th, was about fifteen feet. Witnes stepped it eff. The point where the shot wa tred from is on M street, about midway be tween I2th and 13th. A direct shot would bave had to pass through the fence to strike the man. Witness examined the fenee; saw no place penetrated by a shot. A shot migh have passed through a kuot hole or crack. Robert Harris, . testified that he was with officer Wilson, driving the cart, and when he fired at the dog he was watching tosee that no one g®t in range of the gun. Saw nobody about. Did notsee the man until after putting the dog im the cart; he drove near to the corner and saw bim fall on his knees. Dr. Smith testified to attending the wounded man. Found him lying on the flagway, and bad him taken te his home, where he examined the wound about 7 o’clocka.m. It was evi- dently the result of a glancing shot, which en- tered upon the third rib and ced upward, probably touching the lung. bed the wound as deep as he thought proper, but could not find the shot. Thinks there is ne ganger un- less inflammation of the lungs id en- sue. Dr. Newman testified that at the request ot Superintendent Richards he called upon the wounded man about 1 o’clock p.m. Themus- cular development of the mau and the nature of the wound is such that he could see no reason at all why the wound should prove fatal. The evidence differed but slightly from the evidenceof Dr. Smith. Cortney Moore, ‘arrested by officer Mulloy, ‘was committed to jail to answer the charge of an sssault and battery. with intent to kill Nosh Fields. Moore, it appears, wants to marty a girl named Martha Heffman, and Fields, who is a relative of hers, advises her not to ave Bim. Moore attempted to Fields beyond the power of any further jection by giving him a cut on the head wit hatchet, iracturing his skull.
