Americans writing trom the city of Mexico describe the hittle one as a bright, intelligent, handsome boy, about three years old, with an unmistakable North Amertican—in other words, Yankee—stamp of features and expression. No matter what were the motives for the adoption of the child, the act was in itself unobjectionable: but the banishment of the Iturbide family, and the separation ot mother and infant, were tyran- nical and cruel, and Mrs. Iturbide, who 1s nearly alhed to many old and prominent families here and in Maryland, bas the entire sympethy of this community in her trouble. You will not fail to remember that we were in the midst of a powerfal rebellion—a war waged on the one hand for the dismemberment of the Union and on the other, as 1 have always sup- posed, for its preservation. Those who engaged in the late rebellion for the enbversion of the Government by the force of arms were by the Constitation and the laws guilty of a great crime, and to charge a person With disloyalty at such time, especially with sympathizing with persons thus engaged, 1s slanderous. ist. In the first place you will inquire wheth- er the defendant wrote and published the let- ter set out in the plaintiff's declaration. 2d. Did the defendant intend in that letter to charge the plsintiff with being an enemy of his Government and in sympatny with those who were attempting to subvert it by force of arms, 1f you find these two propositions in the at- firmative, you will pass to the consideration ‘nother question which the law and the ts of the case presents, This letter, if written atall, was written to the Assistant Secretary of War. The plaintiff was then in the employment of that braneh of the executive departinent of the Government, and itis claimed that this communication, if written at all by the defendant, was a priv- ileged communication, and no matter what was its character, or the circumstances attend- ing it, the defendant cannot be made liable in this action. The communication is in one sense a privileged one—if made in good faith— but if at the time he wrote it he did so without probable cause, or knowing it to be false, he is liable. The great question in the case is, was the cbarge of disloyalty. &c.. false! and had the defendant atthe time of writing this letter no probable cause for believing the charge he made to be true ! If the charge was false: if the defendant had no reasonable ground, sueh as an ordimarily prudent man would act upon for believing it to be true, therm be is lable for damages in this action. This action cannot be maintained by show- ing simply that the charges contained in this letter are false. It must be shown that they were not only false, but made without prob- able cause. By probable cause there must be that degree of proof which would convince the mindof an ordinarily intelligent and pru- dent man of the truth of the fact alleged. The Judge proceeded to state that the bur- den of proof to show probabie cause was upon the plaintiff, and concluded his charge by ru- jing upon a number of prayers of the defend- ant tor instructions: and the jury took the case about 11 o’clock, and retired to deliberate on 4% verdict. The jury, on the adjournment of the court, were instructed to render a sealed verdict The jury agreed upon a verdict about | o'clock. as a’ that hour they left theirroom. ILLNESS OF SECRETARY STANTON. Secretary Stanton has been confined to his house for the last three or four days, by a se. vere indisposition, the result of having taken acold. His family have removed to the Sol- dier’s Ilome for the summer, but owing to the illness of the Secretary, be remains at bis residence in K street.
