Some boys came to him fir buckets to carry water. Soon after the tiremen came, and the little boy Zimmerman with another boy weut to his store and asked fora Jampto enable the firemen to fiad the plug. Fearful that the wind would put the lamp out, witness gave the boy a canaie and some matches. James Harrison, Reuben Brown and Edward Ludleton, school boys, testified, but neither of them knew anything of the affair except from the statements ot other boys. Mr. W. J. Rnees, of the School Trustees, Made a statement, showing that he did not ay pear there as a prosecnior of these boys, but merely to hear the examination He had vis- ited the schools after the fire, and ingniring about it, concluded from the circumstanves that ft must haye been the act of some one Acquainted with the premises; and the state- qents of the boys he examined poiuted to Henj. Mr. Norris, who appeared in behalf of Zim- Merman, thought he had evidence to show that his Cent could not hay> committed the act. Mr. Rhees tbought if that could be done it Ws Sli that is necessary. The case | Was postponed till to-day at 3 o'clock p.m. eae ea Tue Witky-Brown Casy.—In the Circuit ourt (Chief Justice Uartter) this celebrated case is on trial. Tne opening was concluded Dy argument before li jurorsand the remaining juror chosen being excused, Mr. A.J. Joice ‘was empannelied in his stead. This case comes up ou the following assues from the Orphaus’ Court: 1. Whether the petitioner, Emily F Wuey, is the child of Tillotson P. Brown. 2 Whether the said Tillotson P. Brown was ever married to the mother of toesaid Emily F. Wi- fev. &. Whether, after the ssid marriage, tne #aid Tillotson P. Brown ever acknowledged the said Emily F. Wiley to be his caild. The tacts in the case as alleged by the plain- tiff, appear to be as follows: Tillotsun P. Brown, s0n of Marshal Brown, (of Brown's Hotel) while atschvol in Alexandria, during his youth, in his freqeent visits to Washington, made the acquaintance o: Elizabeth Phillips, swith whom he keptup an intimacy which lasted bis whole life. Abouta year after th intimacy Commenced a daughter was torn and Was treated by Brow his daughter. This daughter is the plat Mrs. Wiley, and it is cisimed that as Tillotson Brown, afew months previous to his death, was united in marriage <o the mother, that she is the betr at-law tothe exclusion of the collateral liues uuder the aittate which says: «If any man shall baye one or more children by any woman whoin he shall afterwards marry. Such child orcbildren, ifacknowledged by the mas, shall, in virtae of sac marriage and acknowledgement, be legitim.ted and ca- pable in law toinherit and transmit iherit- ance, 96 if born in wedi “Thompson's Di-« gest, Laws C., page to On the other hand tha defense alieze that MMre. Wiley cannot be the daughter of Tillotson Brown; that the motber, previous to the birth of the child, was cohabitmg with mea other than the reputed father, makingit questionable as to who is the father. This case has now come up the third time for trial, cn the two previous oecasions the jury failing to agree upoa a verdict, and thus faron this trial there has been but two witoesses sworn, Dr. Condict, who wis the attending [| accouckeur at the birth of the petitioner in | 1555, and Mr. Wolf, who for some time acted as the agent of Mrs. Brown, the administratrix. Messrs. Browning, late Senator from Lili- mois, and Eobert J Brent, ot Baltimore. ap- peared jor the petitioners, and Messrs. Brad- dey, Sr., and Davidge, for the respondents. <2? OeyTzx MARKET, To.
