J CHARGES OF KIDNAPPING, PERJURY, &C — ‘Tuesday, Major ©’ Beirne, acting in conformity ‘with @ recent act of Congress, sent the follow- ing parties to Justice Boswell for trial: Cornelius Feely, charged with signing alien apers, knowing them to be false; Jno. H. owan, charged with causing men to swear falsely before a civil magistrate; Michael Kelly, charged with the same offense as Gowan; Jno. Holleran and Jno. Clark, charged with kidnapping in the District of Columbia, a col- ored man who was enrolled in the State of Maryland. The alien papers to which the signature of Feely is attached was drawn by Chas. Walter, Rotary public, om the 7th inst., and set forth that Jobn Cherry is British subject, known to Feely as such; is 27 years of age; born in Ireland; that he never declared his intention to become a citizen of the United States, &c. To == document the name of M. Kelly is also signed. John Cleary testified before the Board of En- rollment, March 7th, that he was a private in company O, 40th N.O. volunteers; deseried at Fort Anderson, near Wilmington, N. C., about February 16, 1865. About four days before he appeared at the Board he went to lodge at Mr. Kelly’s, and became acquainted with Feely. He told Feely that he came from the South, and had been in the rebel service. Feely want- ed witness to go as a substitute; wituess said he would rather goas a volunteer. Feely said Witness would get more money by going asa Substitute. Witness said he would not mind trying it if he gota goed bounty. Feely told ‘witness he must alter his name, as he had taken the oath of allegiance under the name of Miles Ball. Witess then changed his name to John Cherry. Feely then told witness that whe would take him before a notary public and have slien papers made out for him, and he must swear be was an alien, born in Ireland. ‘Witness went with Feely and Kelly, both of whom signed the papers as witnesses. Feely said he would get witness $100 bounty. Wit- ness raid his correct name is Miles Rall. This deposition wastaken by Lieut. S. K. Brown, Deputy Provost Marshal. In the case of Michael Kelly— G. W. Etheridge testified before Lieut. Brown thaton March 1th Kelly approached him at the B. & O. railroad depot, and conversed about the rebel army. Witness asked him if deserters from the rebels would be received in the U. S.army, Kelly said no; buthe woald fix thagfor witness af he would go. Witness said he did not want to do anything wrong or get into trouble.— Keily asked him for his protection papers, and also asked four other friends of witness to go into the U. S. army. Early on March 13th, Kelly took witness to a house near the Capitol . which he said was his own; gave witness a citizen’s coat, a pair of pants, and a U. S. blouse, taking off the buttons; Kelly then gave him a paper purporting to bea certificate of the Corps of Uonstraction, for three months and pine days labor at Chattanooga in 1464, telling witness to answer to the name on the aper, which was J. Sanford, and say he be- onged in California, and was an employee of the Corps of Construction previous to coming to Washirgton. After this he told witness that after he was in the army, if he would de- sert and feet him again, they would go toa place he named and do itagain. He showed witness Sh og a which he said was transpor- tation to the place he named. in the case of John H. Gowan— Richard Thompson testified that he lived in Prince Geerge’s county, Maryland, and issub- ject to draft there; came to Washington to vol- unteer and get rid of the draft, met with John H. Gowanat the Navy Yard; he asked witness if be would goas a substitute for him; witness said he did not know if the authorities would Pra it; Gowan said if witness would go for im he would fix matters ali right; that wit- ess should take an oath that he wasa resi- dent of Virginia; witness replied that he could notdo that. Gowan then said he would state the case to the magistrate, and that witness would not have to kiss the book, (which wit- ness says he did not do); Gowan kept the pa- pers until witness was bronght to headquar- ters, Provost Marehal’s office. [The papers referred to by witness were drawn up by John 8S. Hollingshead, Notary Public, March 13th | At4 o'clock yesterday the cases were called up for a hearing by Justice Boswell, Mr. W. Y. Fendall appeared for the United States, and Messrs. Ford and Hine for the defence. The evidence was the same be hk to the military suthorities and Justice Boswell. Ail were held to bail for court except Feely, whose case ‘wa&s continued until 1 o’clock this evening. In the case of John Clark— Joseph Ross, colored, was sworn, and testified that on last Saturday, he had come from Mont- gomery county, Maryland, to the Centre Mar- wet, with Mr. Federline, with whom he was engaged; that Mr. Federline started him, with aman wiohad boughta keg of eggs, to his house to bring back the keg; that, when they arrived at the house, the man took him through two rooms, and then up a pair of stairs into a room above; thathe asked him if he would take a drink, when he replied “no.” A man then came up to the same room with them, when one of them locked the door. Witness then wanted to go back to market, when one of the men struck him on the head with the keg containing the eggs. The other man told the one who struck him not to do so, and told the boy to sit down on the bed, that he should not be burt. The men thenjasked him if he want- ed to enlist, and ke told them he did not. They Kepthim there about an hour; thought it was about 12 o’clock; and then one of them took him out, and got into a buggy with him and drove to the Provost Marsnal’soffice. There he gave him & paper to take into the office of the Board of Enrollment, and told him to say that his name was Joe Henry. He went into a room where he found a doctor, who passed him and sent him into another room, where he told what had been done with him, and the parties were arrested. if H. Dudiey Was sworn, and testified that Holleran and Olark brought the colored man to him, at the Provost Marshal's office; tnat inex were runners, And had brought him sev- eral men prior to that time. Charles Riddle was sworn, and testified that lark and another man had rented a room of him about ten days since; that the door of the room had no lock or fastening ; that he had been with Clark on Saturday until about noon. Clark was ordered to give bail for court. The case of John Holloran was postponed till four o'clock this afternoon. K, 13th N.Y. cavalry, having on a Metropolitan Po. lice uniform coat, and @ badge hid under it, ‘The coidier was sent to the central guardhouse for investigation. The badge belongs to Officer Boose, of the second precinct, and was lost by that officer on duty at night in the vicinity of Campbell Hospital. The coat has not been raced toits owner, but is supposed to have stolen from cne of the stations.
