EXAMINATION OF JCHN ¥F, LUSBY ON THE CHARGE OF BRING THE PERPETRATOR OF THE CRIME, BEYORE JUSTICE KINSEY—HE 18 COMMITTED TO JAIL FOR COURT. On Saturday evening, the examination of John F. Lusby, who, it will be Tecollected, was rearrested by ollicers Allen and Wise, on the charge of being the perpetrator of the horrible Outrage upon the person of little Octavie Ros- seau, in November last, which resulted in her death, was conciuded before Justice Kinsey— J.H. Joh m Appearing for the prosecution, and Messrs. J. H. Bradley, jr. and W. Y. Fer- dall forthe defense. Atthe previous hearings of the case on Wednesday and Thursday, the prosecution haying given in their testimony on Saturday, the evidence for the defense was called, when bim about len minutes to walk from home, distant about as far as the City Hall. He must bave been a snail of a welker. When cross- examited he could give no coherent accountof his movements afterwards. In reviewing the matter he could not see but that he had prob- able cause to send the accused up to court, and the prisoner was therefore remanded to jail to await the action of the grand jury. SSUES SSE Fir8.—The slarm sounded from box 31, about one o'clock Sunday morning, was caused by the discevery of fire in the liquor store of Pat- rick Crowley. No. 25% 4% street, between Pennsylvania avenue and CUstreet, north. The fire was extinguished by the neighbors with trifling damage to the premises. Charles Watkins (colored) sworn.— Witness Was employed m working on the columns for the Capitol, which are carried up North Capi- * tol street. On the day of the occurrence he was working near Mr. Donaldson's restaurant, and worked until past six o’clock. As near as he could fix the time, between four and five o’clock he saw alittle girl playing near Mr Donald- son's restaurant, and when he stopped work he left her playing on the hill near by. Witness did not know who she was. On the same evening witness SAW & man come along by Mr. Donaldson’s, where he stopped a moment, and he then went to the corner, (B and North Cap- jtol streets,] and sat on a stone, where he re- mained until they stopped work. This man wore a soldier’s overcoat, dark pantaloons and dark brewn slouch hat. a The prisoner here stood up for identifica- tion, but witness conld not say that he was the man. Wesley Taylor (colored) sworn. -— Witness cor- roborated the testimony of the preceding wit- ness as to the child playing on the bank and the man setling on the stone.-who he described As wearing & soldier's overcoat, dark pants and slouch hat, and was shaved clean. As the prosecution had neglected to produce the original, they de- manded the right to introduce the next best evidence. The prosecution contended that the paper had nothing to do with this case, and stated that ne notice to produce it Bad been served on them. Justice Kinsey said he had no objection to hearing the paper read, and would give it the weight he thougbtit was worth. ‘The abstract of the report of Dr. Erni of the analysis was read from the Star ot December 19th, and James Croggon testified that in the main it was 4 literal copy. ‘The argument was commenced at a quarter past six, and Mr. Johnson, forthe prosecution, Opened in the beginning, describing the enor- muty of the crime, rape and murder. He re- viewed the evidence, and contended that those portions of the evidence offered of ths confes- Sion of the prisoner as to his baying a mania, and to the conversation Dr. Ford had with the deceased, which had been ruled out, pointed unerringly to the prisoner as the perpetrator of the crime,and he was satisfied that the Court would allow this evidence to go to the jury. Nevertneless, without this evidence, there was enough to warrant the prfsoner be- ing remanded. He argaed that the fact of Mr. ‘Wood not being admitted at once, when he went to the house to arrest the prisoner, was agaist him. Even the testimony ot the two colored men for the defense was in favor of the prosecution, for they described, with the ex- ception of the hat, the dress worn by the pris- oper, and in the twilight it was easy to mis- take a flat cap for a black slouch hat. The other witnesses for the defense contradicted themselves. Mr. Fendall for the defense followed, and he reviewed the circumstances connected with the case. The prisoner was a young man of family and has been suspected and arrested for the offense and after an examination before One of the highest law officersin the country was honorably discharged. He now asked at whose instance he was arrested—on a warrant issued at the instance of Mr. Allen. The same witnesses bad testified on this examination and the question was whether he was to be held on the same evidence. Mr. Fendall here spoke of the fresh testimo- ny, that of Mr. Alexander, who heard some statements from the prisoner while in j: which it was sought to construe into a contes- sion. This witness was in jail on a charge of felony and discharged on the condition of his turning states evidenee, but when he went be- tore the grand jury they refused to believe him and the case was dismissed against the other partes. His object was gain—the question with him is whether he will get the reward The prosecution was upon the suspicion of the officers. He denied that Lusby was the man who committed the deed, and asserted that the Additional witness, Alexander, was not enti- tled under the circumstances to belief; and in conclusion be argued that the duty of the jus- tice under the cireumstances was to dismiss the case. Mr. Bradley followed Mr. Fendall. It was the duty of the magistrate to hear the evidence and determine whether the evidence pointed to the prisoner or not.” He contended that the evidence did not point unerringly to the pris- ober. As to the prisoners being seen in the vi- cinity of the occurrence, ifhe showed toat the prisoner was not in the neighborhood after five o'clock he should demand the prisoners dis- charge, and he proceeded to analyze the evi- dence for the prosecution and contended that he bad proved that the prisoner ws not in the neighborhood. The person who committed the deed was not the prisoner, but the man left on the stone after six o'clock. Mr. Johnson stated that the avowed object of the defence was to prove an alibi, but tl ey had failed, and asthe hour was growing late (920), he would submit the case. = J Kinsey said that this case had great. y exercised him, and he had devoted many bours tott. He could not agree that Alexan- der bad perjured himself; he thought he had spoken the truth.. Itis evident that the little girl Engle gave a plain, unvarnished siate- ment. She stated that she met the prisoner about four o'clock, near the Old Capitol, and the young man Shafer saw him about the same hour near tke depot. It was clear that the prisoner went in the direction of Mr Rous- seau’s. The colored men describe the dress of the prisoner with the exception of the cap, but that was easily mistaken.
