S Pat- terson, was brought to a close, the counsel agreeing toa compromise. The parties to this snitOwn property in the square on the north side of the Avenue, between {th and 10th sts., through which 4 water course runs, carrying oft the water from the neighborhood of Frank- lin to the canal. Into this course a private ten-inch s@¢wer empues, which most of the residence of the square use. The building of the piaintit! is near the water course, and it is Alleged that owing to the defendant and others not keeping the sewer in repair, the cellar of the defendant bas several times been over- flowed and hi- property damaged. The sait was brought in « friendly raanner, to deter- mine the question as to the liability of the par- ties to keep the sewer in repair, and their liability for what damages have ensued. After argument by the counsel, the following instructions were agreed to by them and given by the Court to the jury, who rendered a ver- dict in accordance therewith : The Court instructs the jury that ail the par- ties using the said drain are equally liable to said plaintiff for sny damage resulting trom their failing to keep the same in repair, and the whole amount thereof should be equally divided between them Itis agreed that a judgment be entered, in this caw for =400 damages, and the costs of the clerk and marshal each party to pay his own costs, except the marshal’s and clerk's fees It was agreed that the case of Wall agt. The hail was crowded (t $1) and witha fine ap- preciative andience. This concert afforded an opportunity for the public to enjoy some first-class mmsical talent | that has heretofore delighted and electrilied private circles in this city. We have uever seen a professional concert where the perform. ances were so uniformly good.
