This order will put an end to a fruitfal source of disease in this city, from the num- ber of decomposed bodies brought here and stored in the heart of the city by embalmers. No changes have been made in the organiza- tion of late, save that at Camp Stoneman, and only two appointments of officers have been made since our last published list, NAVAL ENLISTMENTS. From areportof the Provost Marshal Gene- ral, presented to Congress this afternoon, it appears that there were 67,687 naval enlist- ments from the 17th of April, i861, till Febru- ary 21, 1861, all of which were credited to the quota of the several States in which the en- listments took place. TENANT HOLDING OveR—Krause v3. Talbert. A case of this character has been attracting the attention of lawyers and others at the office of Justice Johnson,and though it has had sey- eral bearings, it has not yet been decided. At the last hearing. Satarday afternoon, Messrs. Davis for the plaintiff md Phillips for defence reviewed the facts of the case, from which we gleaned the following: Mr. John Talbert was for nine years a tenant of Mr. George H. Plant. At the end of that time My. Plant disposed of his right and title to the property to Mr. Lewis Krause. Mr. Krause, anderstanding from Mr. Plant that Talbert was a monthly tenszt, gave Talbert the thirty days notice to leave the premises, as required by law of a monthly tenant. Mr. Talbert claimed thathe is a yearly tenant, and entitled to six months notice. The evidencaot Mr Plant wasthat he never Jet the house to'a yearly tenant, 2nd that the house was rented by agreement with Talbert’'s wife by the month, and the paymerts were made monthly. The defense denied the agreement td occupy as a monthly tenant, his wife never having been authorized to make any such ccntract. Mr. Phillips argued that Talbert, being a yearly tenant of Plant, could not, by tite trans- ter of the property, be made the montkty tenant of Krause, it being a fandamental principle of law that the rights of a party cannot be aifected by.any act ofa third party. Mr. Krause has no other rights thar those he received from Plant. The defendant is a yearly tenant—was from the first—and the plaintiff wishing to prove a special contract, should do so by a disinter- ested witness. The evidence of Mr. Piant, under the circumstances, is not sufficient, he being to a certain extent intsrested, as the sale Was made upon his representation that the de- fendant was a monthly tenant. Mr. Davis. for the plaintiff, said he was as- tonished at the position taken by Mr. Philips, that though the defendant was at first a month- ly tenant, having lived nine years in the house he became 4 yearly tenant. r. D. proposed a problem:—If possession nine years made & monthiy tenant a yearly tenant, how many years does it require to give a tenant a right to a deed in fee simple? Mr. Dayis did not feel called upon to answer the points propentee by the connsel, but he felt satisfied that the positive unequivocal testi- mony of Mr. Plant, the defencant is a monthly tenant and entitled tothe thirty days notice only, and the fact that pigintiff had proceeded regularly according to the act of Congress con- cerning such cases, would insure a judgment in his favor.
