Kine was disposed Of Saturday, before the Military Commission, on F street. | The councel for the defence, Mr. Fendall, re- marked that the only evidence against the boy was his own wild utterances, while suffering untoid agony from a wound received, which ‘WAs supposed to be mortal atthe time. How the wound was mace would have been shown bad the father of the boy been allowed to testi- ty on that point. Hethen narrated briefly the facts of the case, which are, we presume, familiar to most of cur readers. The members of Montgomery King’s family ‘Were on termsof intimacy witha family named Counsellor, living four miles beyend Tennally- town. Young King, at the time of the raid on Washington, in July, 1561, was visiting at the Douse of the Counsellor familp, and was seen in the company ofason of the Counsellors on three successive days, among the rebels, but having neither armsor accoutrements; on the fourth day he was taken tothe house of Mr, Centre, badly wounded, and in alow condi- tion, by persons in plain clothes. While he was lying there. many persons visited him, some to pity andsometobisme. He told while - in this state, that he had been within one and a half miles of Reckvitle, and there joined tha revel army. and he made other declarations, which the judge advocate had on file. The conisel for the accused reveiwed the testimony, and from it deducted that the boy's reason was staggering, if not dethroned, and | that his declarations were altogether inconsis- | tent with his previous course of life. He also | cited casesin English courts where persons bad, in moments of intense ‘tear or anguish, confessed, and been executed for deads others were afterwards proved to bare committed. j But, admitting his statement to ba true, what Were the facts of the case! He had enlisted as & soldier of the 22d Virginia regiment; was wounded while fighting for the Confederacy, @nd should now be treated as a p: r of war. But he sgain enbmitted there Was no evidence against the accused but hisown un- supported, uncorroborated testimony, and on that ground he asked the discharge of the boy. The Judge Advocatesaid im that young King ‘was witha young man named Counsellor, both he and the counsel for the accused wereagreed. ‘That young man had since gone irto the rebel army, It was in evidence that young King, when wounded, was brought to Uentre’s by Tebel soldiers, accompanied by a rebel sur- geon. The evidence of Mr. Helm, was that ee tack suppcesed himself atthe point of death. A statement made at that hour was Siways invested with a higher and holier character than a mere ordinary statement. There was ne evidence of delirium or ince- herence in his statement. As to the nature of the wound and its liability to produce deliri- um, doctors agreed. There was no doubt that young King knew what he was about. Miss Gingel caw him with the rebel soldiers. The Jucge Advocate was aware of the youth of the prisoner, and the follies which attach to that period of life. He had simply stated the @ase, and would there rest.
