THE MURDER Or UAsSIM D'ARNAUD.—Yes- terday evening an examination of William H. Berry and Wiiliam H. Cox, charged with be- ing concerned in the murder of Cassim D’Ar- nang, a soldier of the 12th V. R.O,on Monday afternoon, December 26th, near the corner of 2d and F streets, (Isiand,) took place at the headquarters of the Metropolitan Police, before Justices Handy and Boswell—Messrs. E. 0 Morgan end S. L. Phillips appearing for the accused It will be recollected that the coroner's jury Feturned a verdict that the deceased came to bis detth from & wound through the neck eaused by a shot fired by Berry. and that afew days after the murder Berry, who had gone to Philadelphia, returned and gave himself up to Sergeant Milstead of the eighth precinct. ‘Cox, the sailor,and James W. Gatton were arrested by detectives Clarvoe and McDevitt, and the latter was held to bail as a witness and Cox as accessory to the murder. The first witness called was Gratton. (a young man of 17 or 18,) who testified that on the evening of the occurrence Cox and Quigley came into Mrs. Clark’s after the first fuss, Which occurred about 3% o'clock, and went out the back way. Berry went out to look for them, and shortly returned, saying he could not find them. itness and Berry then went to Mrs. Rohletter’s, and while there a boy came in and said the soldiers were beating Cox and Quigley. Witness and Berry went out, and when they reached the corner they saw Cox and Quigley jawing with soma soldiers. Berry went towards the crowd, when a soldier ad- vanced towards him and struck athim. Berry Knocked him down, and when the soldier got up he went to the left of the crowd and put his hand behind him, when some one said, -+Don’t draw anything here.” Aboat this time witness heard a pistol shot, and tarning saw a pistol in Quigley’s hands. They all then ran, and he heard a soldier say to some one, *‘I’1l mark you withacapon” (uigley had acapon. Wit- ness did not see Berry with hand knuckles on. By the detense — Witness heard only one re- port. Cox did not strike a blow; Berry had nothing in his hands and was at thetime the shot was fired tusseling with another soldier; there were seven soldiers and Berry, Cox and Quigley in the crowd. One of the soldiers stood off and leoked on, and he was the one who said «I mark you,” &c. By the Magistrates —Cox hada billy in his and at the time, but he did not strixe any one; De was notin the crowd, but was swinging a billy and walking backwards and forwards, and appeared to be drunk; Cox had his coat on bis arm. Elizabeth Champ, col., sworn.— Witness lives in the alley, between Ist and 2d street and when she first came to the door they were fighting, two soldiers being hung together tusselinz; the soldiers were om the left and the others on the right; one on the right side shot the sol- dier, but witness did not know him; only knows that be had on a dark coat or shirt; the man threw up his arms andran. Harriet Glasco. colored, sworn.— Witness was going to the pump and saw Cox and a soldier wrestling, and saw the man shoot the soldier; he had dark clothes on. (Witness here identi- fled Berry as the man.) Cross-examined.—The man who shot had on a dark coat, dark pants and plain waistcont. James Gant, (& little colored boy 12 years old, ) Sworn.— Witness was playing and saw three soldiers run up to Cox when Berry and unotk- er boy came along across the street. One of the soldiers struck at Kerry and Berry knocked him down with his fist. The one with saiiors clothes on drawed a pistol and put it in the soldier's face, when that boy (pointing to Berry) jerked it out of his hand. The soldiers started and one said he would mark theone with the cap on. Cox and Berry wentinte Mrs. Clark’s, and in a jittie while Berry came out, but Miss Anna Clark and Mrs. Clark pulled him back. Witness then went home and in alittle while heard something ge off; don’t think it was more than five minutes afterwards. When witness came out he saw Coxand Berry. (Luigley was wrestling with a soldier. William Pierce, (& little boy of ten years,) sworn. —Witness saw Bill Berry and three soldiers fighting near Mrs. Clark’s. About two hours afterwards a fight commenced back of Adams’. A soidier said something to Berry, and three or four minutes atterwards Berry came around the corner and shot him. Cox was Wrestling with a soldier, and Quigley was trying to make peace at the time. James W. Gatton was recalled, and stated that Kerry wore on the day of the occurrence checked pants and vest, black coat and hat. Qui, wore dark pants and vest. Berry, at the time the shot was fired, was not standing in the direction from whence it was fired. John A. Clarvoe, (detective, )swern.— Witness had had a conversation with Berry in jail, in which he sta‘ed that he had thought best to give himselfup. He also said that he did not Tire the pistol, but that (Quigley did, and stated that ()uigley had buried the pistol in the mud in the canal. There being np other witnesses for the pros- ecution present, the defense was called, and Patrick Donovan Was sworn and testified that he eaw tbree soldiers coming down the street and three men got to gabbling with them. One of the soldiers appeared as if he wanted to make fight. Cox made 8 charge against & sol- dier who ran &way. Witness saw Berry strike a soldier with his fist. Thesoldiers wantaway and came back in stronger force, and heard the soldier who was killedsay You s—of b—h, are you going to run away now.” Witness cid not see the hoys then, but afterwards saw 8 soldier have Cox by the arm, and saw Berry run around asif he was trying to get Uox away. Some of the soldiers charged against Berry, and he knocked one down, and be.ore he (the soldier) got up he (witness) saw & man come up and firea pistol. The man who fired had his coat, which was @ heavy one, buttoned up, while Berry’s wasopen. Some of the soldiers opened their knives in the crowd. By the Magistrate:—Witness did not see Berry at the time the shot was fired, nor did he gee any brass knuckles on Berry’s hands. Lawrence McVary testified to having seen a soldier strike Berry, and to hearing a shot fired afterwards. George Swope testified that he saw a man shoot the soldier, bat the man was not present. ‘Witness was certain that Cox, Gatten or Berry did not shoot, and he had not seen Berry that day. Taaries Hammer, sworn.—Witness was in Mrs. Clark’s, and three soldiers came along, when Cox and Berry went out and got totalk- ing with them, and the latter strack one in the Mouth. Afterwards Cox and Quigley got into @n altercation with the soldiers, and he ran towards the crowd and heard the shot fired. He did not see who fired, but heard a soldier say to Quigley, «Never mind, I’ve got you marked.” ir. Grammer testified to hearing the report, but did not know who fired. J. N. Pumphrey testified to Berry’s striking a soldier about an hour before the shooting. The case was here adjourned to Monday morning. PRESENTATION.—Last evening about a doz- en of the oldest members of the Columbia Ty- pographical Society, upon an invitation ex- tended by George S. Gideon, Esq., visited that gentleman’s residence, corner of Sth and K sts., where he presented to them, (as a Oommittee of the above-named Society,) inaneatand appro- Tiate speech, the imposing stone, (which has been in the printing office for over fifty years,) upon which was drafted the Constitution of the Society, by the late Jacob Gideon and oth- ers. The stone was received by Ferdinand Jeffezson, an ex-President of the Society, on the pari ot the Committee, and maae the reply- ing Speech, tendering to Mr. Gideon the thanks of the Society for, and their® high appreciation of the present. It is fifteen by twenty-one inches, and is set ina black walnnt stand about table height, neatly boxed up andon rollers. The stone is neatly dressed, and bears the following in- scription:—“Imposing stone on which was drafted, A. D., 1815, by the late Jacob Gideon and others, the Constitution of the «Columbia Typograhical Society.’ Presented to the Society A. p 1865, by George S. Gideon, Esq.” Atter the presentation ail enjoyed a bountitulsupper prepared by Mr. Gideon, and the champagne ‘was let flow witbout stint. The stone will be presented to the Society by the Committee to-night, and will betaken trom their to the Seaton Heuse, where the Typo- graphical Supper will be held. ae Navy-Yarp.—The Don, flag-ship of the Potomac flotilla, left this morning, Report has it that she has gone to sea. ‘The mortar schooner Sophronia has been put in complete repair, and it is expected will sail to-day for Key West. The Bat (formerly a blockade runner) is being repaired. The Freeborn, which is under repair, is nearty ready, as also the Juniper. The Commodore Reed is being put in fine order. The Stepping Stones has been hauled out cn the ways, and will receive a thorough over- hauling.
