The roarr ; farce of The Two Grocers” to- night. ———— Tue Triat or Dr. , Keasny.—The Court. martial which holds its sessions at No. 407 11th street, and of which Brig. Gen. Briggs is Pres- ident, and Lieut. Vol. Burtam Judge Adyocate, yesterday resumed the case of Dr. J. B. Keas- by, and at 12% o'clock took a recess of three quarters of an hour, the witness tor the prose- cution, Geo. H. Cassidy, naving just testified to the conversation between himself and Chas. A. Keasby regarding the man Alexander, whom, it is alleged, Dr. J. B. Keasby accepted for his brother after having rejected him tor Cassidy. On reassembling at 1 o’clock— Hienry H. Dudley was sworn.—Resides at Kirkwood House; is a recruiting agent; knows the accused: also Chas. A. Keasby; did not know of more than one case where any one of two persons was accepted and the other re- jected, which was where a white man was re- jected in October last by Dr. Keasby, and after he was rejected he: was presented to Captain Putnam by witness and was accepted. Q. State whether you know of Dr. Keasby baving purchased or assisted in purchasing recruits, and if so their names, whom they Were purchased of, and at what time! Objected to by defense,on the ground that the question was too general, and which was overruled. Witness resnmed.—Knew of © men present- ed by Arnold which Dr. Keasby had pur- chased; heard Capt. Scheetz tell the doctor he must not let that happen again in the oilice: Dr. Keasby replied (hat he was not aware that he had violated the rules; witness did not know that Dr. Keasby was engaged in tbe re- cruiting business. Witness here presented the names of the men presented by Arnold, whith are:—Joseph Smith, William Smith, William Adams, Jas. Carpenter, John Mason, Robert. Dangerfield, Benjamin Newton, and Lloyd Sher wood; these Were presented about the 12th of May. By defence :—Dr. Keasby examined the white man presented and rejected him as under size; afterwards referred him to Captain Putnam, who accepted him; Dr. Keasby was the only surgeon in the room at the time the white man ‘was In and rejected: testify to the 8 men merely from memorandum on the book; do not know the men; their names are on the book; was not positive (hey were the men. Augustus O. Kall, Clerk, 536 7th street, Wash- ington. sworn.— Knows the accused, also Mr. H.H. Arnold, witness was Clerk in the Board of Enrollment from June 27, 1863, to October 22, 1564; Arnold, was an suthorized detective; Ar- nold brought, he understood, 9 substitutes, of which 5 were accepted and | rejected; Dr. Keas- by bought them and paid $200 for them to Ar- old; the substitutes were intended for Dr. Dudley; but the doctor got them; this conver: tion witness heard between Captain Scheetz and Dr. Keasby; Dr. Keasby said he had made #80 for Charley; Captain Scheetz remarked, and that ts the kind of receipt you gaye. By defence :—All witness knew of the affair was whathe heard between the doctor and Captain Scheetz; did not know any of the men presented; Uharles A. Keasby was in the habit of bringing recruits to the office; something was said about the recruits being for Dudley; Dud- ley was not there when the recruits were brought in. By the Court:—Captain Scheetz informed the doctor, in substance, that he had no business to deal in substitutes; the doctor said he was pot aware that he had violated the rules; at the time of this conversation Mr. Boyden and Mr. Aber were in the office; Mr. Aber and Mr. Boyden were both clerks in the room; it was in Capt. Scheetz and the doctor’s room; wit- ness knew the men were accepted and mus- tered into the service; there was nothing in the conversation to show whether the men ‘were accepted before or after the doctor was alleged to have paid the £200, there were sey- eral conversations regarding the affair; the men were credited to the State of Massachu- setts, do not Know that the doctor, his brother or Mr. Arnold received any bounty from Mas- sachusetts; that State was paying $100 per man; Capt. Scheetz paid $25 for every recruit presented; this money was left there by Mas- sachusetts agents; there were several State agents from that State; the $100 bounty was an Outside arrangement. 4 Court adjourned to 11 o’clock to-day. ee Dism1seeD.—Some time ago Mr. Sewall Brint- nall, wood dealer, warranted Fanny Mitchell for fuel, and obtained a judgment for ten dol- jars before Justice Clayton. On the 2d instant Fanny Mitchell warranted Mr. Brintnall for $25. On the 3d instant Mr. Brintnali appeared before Justice Hollingshead, and Fanny Mitchell appeared as a witness. She stated ‘what character of house shi the amount sued for was the balance of a bill against him. She brought up a colored girl as a witnese to identify Mr. Brintnall, and this ‘witness, instead of pointing out Mr. B., posi- tively identified a gentleran who had nothing to do with the case. The case was postponed until yesterday, and the parties appeared. Justice Hollingshead said that there was no need of argument or further evidence. From the evidence of Fanny Mitchell herseif it was clear that the case was the resuit of malice, growing out of the case decided by Justice | Clayton; and in view of this malice and the prevarications of the witnesses, the case is dis- taissed. alee SS Decne or Divorce GrantTeD. morning, Judge Wylie, sitting in e esterday ty, made a decree divorcing Susannah Kurb, formerly | Michel, from the bonds of matrimony with Joseph Kurb, and giving her the right wassume her maiden name. The petition in this case was filed July 22d fast, and sets forth that she married the re- spondent April 29, 1559, in good faitn; that she lived with him as bis wife until ilth of July last, When she ascertained that he had been guilty of pened that he is of intemperate habits and contributes nothing to the support of the two children, and that on the 12th of July he cruelly mattreated her. On this peti- | tion evidence was ordered to be taken by Com- missioner Brown, and three or four witnesses ‘ified to his having been closeted at his res- taurant with a colored girl, on lith of July last, and also to his baving sold out his effects and leaving the city. Alexander, Jeweller, had advanced a sum of money on & watch, which kind of business is not legitimate under his li- cense, and arrested and took bim before Justice Thompson, who fived him 245 for violating the corporation law. It appears that Se ewe lers are not aware that a corporation license gives them power only to buy and sell goods, and not to loan money on goods. —_<~———_—_ ProvaniTy.—Monday afternoon, James Cal- lan was arrested for profanity in the Fourth Ward, and w4s fined $10.58 by Justice Giber- son. Theaffair grew outof a civil suit between the accused and Benedict Milburn, in which Callan was successful. Latrobe, who has been & prac. tiring physician in Baltimore for 35 years, and intimately acquainted with the accused, on bsbalf of the accused, testified, he never heard him spoken of as anything bat a loyal man. Hugh L. Bond, judge of the criminal court of Baltimore, witness for the accused, testified he never beard Mr. Waters classed with the dis- loyal; thought he (witness) would have known avd it been so. This closed the testimony, and the case will be argued on Thursday next.
