It was testitied on the part of the plaintiff in a-e that north E street, between 17th and J3th, had been opened and graded some ten or Bifteen years ago: that the water since that time a dangerous gully across the street, including the part where the pavement should have heen. The street, however, was not payed. The breakin the street had been tnere for some years past, and in the month of Cctober, 1563, the plaintiff fell into this breakin | the street. severely fracturing his ankle, and was otherwise injured. Jndge Olin charged the jury as follows:— ‘This sction, gentiemen of the jury, is brought by the plaintitt, Turner,against the corporation of Washington to recover for an injury alleged to have been sustained by him by falling into an opening ina public street of this city—said opening existing, as it is said, with the knowl- edge of the corporation It is brought upon the theory that by law ex- clusive control of the streeta is given to the corporation, and that the duty is imposed upon | it of keeping themin asafe and passable con. dition, power being granted the city to raise by taxation whatever means may be requisite for this purpose. I will not repeatto you the testimony, fer you no doubt remember it, and it is your proy- Ince to decide upon the facts. I will simply instruct vou 2s to what I consider to be the | Jaw applicable to the case. First If you find trom the testimony that this street had been opened and graded, and thereby dedicated to the public use, that mo- ment the duty was imposed upon the Corpo- ration of keeping it in repair and in a secure and passable condition. If the Corporation tailed to perform its duty im this respect, and deft the streetin an unsafe and improper con- dition, then it is hable for any injury sustained by such negiect of the Corporation, if it is found by you that the plaintiff exercised ordi- nary care. If be did mot use ordinary care, and the injury was the result of hisown negli- gence, as wells that of the Corporation, then hecanno'recover. Lought, however, perhaps, to observe that the law does not presume negli- gence. That is always a subject of proof, and it will be for you to say whether in this case there is Any proof tending to show a want of ordinary care on the part of the plaintiff. What J understand, gentlemen, by the term “erdinary c&re,”’ as applied to this case, is that ecsare persons ordinarily exercise in passing along our public streets. Second. 1f you-tind that this street was out of Yepair, and in a d&ngerous condition, and that abe plaintiff, using ordinary care, received this | injury while passing over it, then the other question will arise as to what compensation he isentitled. Upon that sutject I instruct you that if you find he is entitled to recover, he is entitled to recover not only for his loss of time, and expenses incident to his confinement, such Asthe attendance of his physician, &c., but he isentitied to have considered, in estimating the amount of damages, the pain and sutfering consequent vpon the injury he sustained. The law can lay down no definite rules by ‘Which to measure an item of this kird, but your sound judgments will enable you to Adjust the balance between these parties, if you find the Corporation alone was in fault. The question presented in this case is both important to the rights and obligations of the corporation of this city, and to the best interests ofits citizens, and your verdict will do much, 1 doubt not, towards enforcing the obligations at the former, and protecting the rights of the jatter.
