Just go and see Williams dance in, out and on topofa half-bushel measure; it is worth the admit- tance fee alone. > Vervict vor DsrEnDant.— Yesterday Morning, in the Circuit Court, (Judge Olin,) in ‘the cace of A. J. Stansbury agt. the Mayor, Kc. of Washington, a verdict was given for the defendant. The plaintiff brought suit for damages sus- tained by falling into an area on the edge ofa sidewalk on !3th street, near G street, in Jan- mary, 1861, which was constructed for the pur- pose of admitting light to a basement. The area was about 3 feet long, | foot wide and 2 Teet deep. The pisintiff’s counsel, Mr. Vaverly. argued that the corporation’s duty was to keep the Streets and highways in secure condition for travel; thet it was impossible to make such Breas & was the cause of this accident without proper protection, and the want of a grate there should be considered a defect to which should pe added the want of lightin that section of the city. He contended that the corporation should be beld liable for these defects. The defendant's counsel, Mr. J. H. Bradley, argued that this was an ordinary defect for which the city could not be held liable, and that the plaintiff coaid not have used due care or the accident would not have occurred. The Court instructed the jury that it they found that the opening impaired the safety and security of the current way in such a manner that aman using ordinary care and prudence Would be apt to tailintoitand receive an in- jury, then the Corporation 1s liable upon the oeeg that the duty was imposed upon it to eep the streets in repair and to make them safe and secure. ]t was a question for the jury, however, under all the circamstances, to say whether the safety or security of the street was impaired. Tbe Court remarked tnat the ques- tion had been ingeniously argued to show that this was a mere omission on the part of the councils. lt was true that there has been an omission; but if this act were done and this opening were made by the builder, or by the agents of the Corporation, and this openinz ‘were £0 notoriously existing as to reasonably come to the notice of the Corporation, the same rule would apply. Whether the hole was in tact left there by the acts of the servants of the | Corporation, or persons who rentedthe house, would make no difference whatever, if the jary ‘tind that that opening ought reasonably to have come to the knowledge of the agents of the Corporation, and that that opening impaired the saf+ty and security of the sidewalk. Ifthe jury founa that there was any want of care on ‘&he part of the plaintiff at the time of the al- leged injury, then the plaintiff could not recoy- er, even if the Corporation was in fault in al- Jowivg such openings to remain unclosed. ‘The jury found tor the defendants. Mr. Caverly, tor the plaintiff, tookexceptions and the case gues to the Supreme Court in banc. a ARRESTED AND COMMITTED TO JaIL —Thurs- day night, officer- Boyle and Grant, of the ith Ward police, were st Canterbury Hall, and Boyle looking around thought he saw the man Reddy, who was charged in the verdict of a jury of inquest, with inflicting the wounds which resulied in the death of Daniel Lehive, on the Ist instant. Boyle told his suspicions to officer Grant, who not being in uniform, ‘went toa seat beside the person and joined in conversation with him. The conversation re- sulted in the officer being satisfied that this was the identical Keddy who was alluded to by the | ‘witnesses at the inquest. Officer Granfarrest- ed bim and carried him to the ith Ward station Bouse, where he gave his name as W. J. Jones, a deserter from the army, and for some time pastemployedasateamster. Yesterday morn- ing he was taken before Justice Giberson and fully icentified asthe person charged by the jary. Justice Giderson committed him te jail for trial at court >. U.S. Sanitary ComMission.—At a_quar- terly meeting or the Huard of the U_S. san- itary Commission, just held in this city, it was shown that the disvursements for the past six months amennted to #263,000 per month, sim- ply for supplies net otherwise obtainab! wery largely for anti-scorbutic?, always the chief needs of yreat armies; and that, at this rate, the funds of the commission would | met carry them througn another six months. They corsequently appeal to the people of the | United States to aid them by contributions and collections churches to emphasize their sympathy with the bodily cufferings of our soldiers, by a uni- vereal collection on the approaching Thanks- giving day.
