Samuel North etal. ee The Military Commission, of which Major General Doubleday, U.S V.,is president, re- sumed the case ofSaml North etal.,at3 o’cl'k Jastevening, at their rooms, on F street, be- tween !3'h and 14th sts. Present: mal Gen. Abuer Doubleday, U.S. V3 Brig Gen. Francis Fessenden, U.S. V.; Coi. R. Batler Price, 2d Pa cav.; Lieut. Col. T. A. Barker, 4th N.H; Capt. M. H. Etlis. 175th N.Y. V.; Uapt. J.B. Piatt, A.D ©; Col. J. A. Foster, 175th N.Y. V , Judge Advocate. Messrs. Gillett and McPherson appeared in behalf of the accused. The Judge Advocate read a list of seventeen persons whom the defendants wished to have summoned #s witness+s for the defense, one of whom was Reuben Fenton, of Chatuaqne county, New York, and said it was natural to suppose thatthey were asked for in good taitn, butitseemed to him only atrick to gain time, and itseemed very strange that the most of them should bappen to live so far away off Jrom the line of railroads. He said the defense desired these men &s witnesses to testify to the good character ofthe accused, and held that two or three would answer that end. Colonet North need not go beyond the city for that par- pose. He was willing that they shonld have those who might be obtained in @ reasonable length of time, but did not propose to sead to ali parts of the world forthem. He was wil- Jing, to geton with the business, to acknowl- edge the private character of Col. North and Mr. Jones to have been good heretofore. R. H. Gillett, counsel! for the defense, thonght tnat pereons of all political creeds should be summoned to testify to the characters of those xecused. These wi'nesses were not ali intend- ed to testify to the character of one person only, but that the different ones accused desired wit- Lesses from their respective localities to testify to their characters respectively. He said that at least two who lived in remote parts of New York State were absolutely required, as two of the accused were residents of different and re- mote localities, and had no familiar acquaint- ances here. Those two were the only ones whom it would be any trouble to produce. He said they wished Mr. Seymour (brother of the Governor,) 8ammoned, &8 he understood as to how the votes were received in New York, and was familiar with the whole routine and by whom he would prove that Colonel North bad no agency in procuring soldiers votes. Some ethers that they wished as witnesses hap- pen to be out of the city just at this particular time. The counsel tor the defense denied that Colone] North was authorized by any one in New York to commit the crime charged against him. ‘Jhe Judge Advocate said he did not wish to try Mr. Seymour in the present case. He said the crime charged against the accused was that of defranding soldiers of their votes, and the point for the Court to decide is whether or not they committed the act, aud not whether they were commissioned for the purpose of committing the crime. Even granting Col. North was no authorized agent, the defence would gain nothing, for the charge was simply that of detranding solsiers of their votes, and if Col. North was guilty, he shouid be puniched. Mr. Gillet eaid that he would prove by the witnesses that ateach and every hour of the day, business of the office was open and pub- Jic, aud that the former State agent, a political Adversary, was present, 4nd could have seen everything that savored of political or moral wickedness. He said all the votes were taken openly and publicly siace the arrests were made in Baltimore, and he would make it ap- pear in this case as clear asthe noon-day sun that there was no intention of fraud on the t of the accused. Pathe Coart w then cleared to decide whether or not all the witnesses should be produced, but reserved its decision for the present. Mr. James 0. Mr Clephbane here produced the short-hand notes of the testimony of Mr. Jones, and read itto the Court, (this depesition we haye al- y laid before our readers.) Ingraham, Provost Marshal of this Dis- trict, W4s © worn, and testified that he had an order p!aced in bis hauds tor the arrest of four parties, and be arrested two of them—-Colonel North and, if he was not mistaken, Mr. Cohen. He c ceed the rooms fna left Lieutenant Hant in charge, with ins'ructions to allow no oneto ‘nter. {terwards, on the order of the Secre- tary of War, Mr. Bradiry was allowed the use of the front room to answer the questions of soldiers calling there; the papers having been r+moved to the back room, which was retained until Thursday, when the rooms were given up to the commissiuners ot the State of New York on the same authority. Nothing was disturbed in the rooms. After the front room was given up, guard was kept over the back Troum. The keys were delivered to the officer oft the guard, who subsequently delivered them to the Judge Advocate. Lieut. H. L. Hunt, Adjnutantof the Provost Marshal and aide-.de-camp to Col. Wisewell, Military Governor. Witness received instruc. tions and accompanied Col Ingraham to the rooms where Col North and others were placed under arrest. He was ordered to take posses- sion end allow nothing to be disturbed. The door was locked and a corporal and three men were placed on guard. Afrer the front-room was given up the papers were removed to the back office over which the guard was placed. A few days after afew blanks were given in charge of a person who had authority. The Judge Ac yocate asked that the court de- cide as to what witness shall be summoued, and stated that many of them were livirg @ distance from railroads and conld not be reached in less than two or three days Mr McPherson argued that the fact of the blanks being found fn the office was not proor that they were to be fraudulently used, and that they were there tor purely legitimate pur- poses. The high character of the accused pre- cluded their vse ia any but an honorable way, and they would therefore call witnesses to prove their standing. The court was then cleared, and on the doors being reopened, it was announced that they hed decided to summon all the witnesses on the list. and, to allow time, the case was post- poned to Monday, 14th inst. + _ ALEXANDRIA AFPAIES.
