Jackson, charged ‘with complicity in an alleged attempt to cause @n abortion on Miss Maggie Duvall, was con- tinued before Justice Clayton after our report closed Monday. Mr. Amon Duvall, sworn.—Vitness does not know Miss Jacksou. He knew Mr. Lewis, who hed visited his house, and his conduct was uni- formly correct; Lewis has visited his house since Angust last. He has heard that Miss Jackscn had been to tne house. The deceased ‘was taken sick about the 5th of March; she had been ailing for a year past—with loss of appe- tite, kc. The deceased was emplo: in the Note Bureau for three or four months. About 2ix weeks prior to her being taken sick she left the Department. The deceased never was from bome over forty-eight hours at any one time. anes =i meee manne false than the charge in al jon nm produ stated by Baker or others. s piel Dr. Jos, Burrows testified that he was called in on the 11th March, and visited the deceased almost daily until her death. Witness was satisfied, from the rapidity of the progress of the: disease, that one or both lungs had been reviously diseased. Witness had no hesi- ney in telling members of the family and others that she was going to die Witness re- peatea his opinion given at the post mortem, to the effect that deceased had not been pregnant. He would not assert that she was a virgin. Dr. R. K Stone, sworn.—Testified as to the Poi mortem examination and from that exam- mation he found the disease to have been acute pleuro-pneumonia. Oorroborated Dr. Burrows in regard to the appearance of the terns and found it bore the appearance of the unimpregnated uterus. He wasof theopinion that if an operation to procurean abortion had been attempted when the patient-was inclined to tubercles it would act by reverse and proba- bly arrest it. Justice Clayton.—In case of the irregularity of the monthly periods is not the consequences usually an affection to the lungs. - Dr. Stone, in answer ssid tubuculosis is born within us and very trifling circumstances might develop it. Irregularity of menstruation could not possibly be followed by phthisis Dr. Burrows.—The death of Maggie Duvall could not have been the resnit of any suppres- sion of the menstrual periods notwithstanding that euch suppression may tend to pulmonary disease. Joseph L. Summers ( Druggist) —Witness was called over to Col. Baker's office on Friday, aod be was desired to make an analysis of the contents of two bottles. £z-Gor'r Ford objected that there was no proot that the bottles were the same present at tbe inquest—they must be fully identified first. liss Lcura Duvall, (cousin of the deceased. )— Witness knows Miss Jackson, and worked in the same room with her in the Treasury, (in the numbering rvom,) under Mr. Ularke. Wit- ness has been at work there since the 18th of November. Miss Maggie Duvall was there when witness commenced, and she (Maggie) jeft in yee A or February last. Witness does not know Mr Lewis. Maggie had been in ba! health a year ortwo. Never saw Mag- gie and Miss Jackson in company. Witness has been at Mies Jackson’s room once or twice and on occasion met Miss Thompson there. ‘Witness was not intimate with the deceased or Miss Jackson, except at the office. Witness never heard Miss Jackson speak of Miss Mag- gie’s condition, nor did she tell any one so. Witness did not know Mr. Lewis, nor did she ever see him. Never saw Miss Maggie Duvall ‘With bottles, nor did she know of her ever go- ing from the city. Witness did not go with Mr. Hudson to the depot to meet Miss Maggie. She bad no acquaintance with Capt. Hadson. Miss Jackson never told her about administer- ing medicines to Miss Maggie, nor did witness ever see them. Miss Adelaide E. Thompson was recalled—Re- peated her testimony given at the previous ex- amination. Miss Jacksonsaid that Miss Laura first mentioned Miss Maggie’s condition. Mr. Philip Hudson put her in the cars, and when ha came back said that Col. Baker was in the car attbetime. Miss Maggie, witness thinks, went on to Philadelphia on Saturday, and returned on Tuesday or Wednesday. After taking the medicine Miss Jackson said that Maggie was all right The Justice asked what she thought of Miss Duvall's health, judging from her appearance when she last saw her, (the last of February.) Mr. Marbury ubjected, that she was not an adept, that a physician was the proper person. iss Thompson answered that she had studied two years inthe New York Medical College . ‘Witness continued, stating that she (the de- ceased) looked healthy at thattime. Miss Jack- gon said, while Miss Meggie was in Philadel- phia, that she was sorry that she had had any- thing to do withthe case. Miss Jackson at one timecame to witness to if she could take Maggie Duvall to her (wittess’) room, to which sbe replied, ‘No, if there is anything ‘wrong to be done,” and she answered that she ‘was only going to “steam her.” se By Mr. Marbury._What part of the house did Sur. Witness continued:—She did not see Miss Jackson administer the medicine. Miss Mag- ggie visited the house every day during the last of January and the first of Feb- rvary for about four weeks. After this she did not visit the house so often. Miss Jackson's diary was laying about the house and she (wit- ness) took itand gave itto Col. Baker. She mentioned having it, when’Col Baker asked her for it and he afterwards returned it. Wit- ess gave it back to Miss Jackson, telling her what she had done withit. She told Miss J. that she gave it tg Col. Baker to prove certam things and to keep Mr. Hudson, who hasa wife and family in Hartford, out of the pee Mr. Marbury.—Are you one of Ool. er’s detectives? Miss Thompson (tartly.)—If I am, I’m sharp enough not to answer that question. /Laugh- ter. itness knows nothing of the case except ‘what has been told her. She thinks that se first mentioned the facts to Ool. Baker, and she she recollects having spoken to Squire Donn on the matter before he died, remarking that some one ought to tell Maggie’s father. Wit- ness went to Col. Baker on b::siness not con- nected with this affair, and he asked about the ‘Is in the Treasury Department, with whom it was said Mr. Clark had a fine time, and the nameof Miss Duvall was used. Mr. Marbary.—Were you ever in the Treas- ary? Biss Thompson, (emphatically.)—But once in my life, thank God!» (Laughter. Witness saw Miss Duvall frequently at the house, (276 Pennsylvania ayenue,} from the Ist of January to the ilth of Novemnoer. She identified the bottles produced as those which bad been fovnd in Miss Jackson’s room. [The bottles had been sent from Col. Baker’s office. ] Joseph L. Summers, chemist, testified that he had made an examination of the contents of the bottics, but baa not made a minute analysis. ‘The liquid in one was (in his opinion) an effa- sion of tansy, and that in the other stale and stagnant urine. {Laughter.) Mr. Ford remarked that it was a most ridicu- lous termination for a case which had attracted #0 much attention. ‘The justice announced that he was not ready to give his decision, but would give it to-mer- row—the same bail being continued for Miss Jackson. THE DECISION rm. Justice Clayton yesterday afternoon rendered & decision im the case of the United States i Elia P. Jackson, charged “with feloniously Siding and abetting one E. Lewis in attempting or ip procuring an abortion on one Maggie A. Duvall by administering medicines to her ‘Within the last four months, of which malprac- tice the said Maggie A. Duvall died on the 4th inst. in this city.” The decision of the Justice is as follows:— « After a patient hearing of this case and a re- view of the evidence adduced, I am of opinion that medicines had been obtained and admin- istered to Miss Maggie only from the confes- sions of Ella P. Jackson as testified by Vol. L. ©. Baker and A. E. Thompson, and I think two other of the witnesses: but there is not be- tore me any evidence that an abortion was committed cr had on the person ef Mis Magzie.
