Adams vs. Chauncey Hoor and Others.— OnSaturday, Judge Fisher delivered a decision in the case, of the United States in relation of J. B. Adams agt. Chauncey A. Hoor. Adams rented two rooms from Hoor, who 1s a tenant for years, and on the Istof December Adams was served with a notice to quit the premises at the expiration of the month, (3ist.) On the 10th of December Adams was ejected by Hoor, the latter scting on_the advice of his counsel. The following day Justices Johnson and Bates came to the premises, and after hearing the case they fined Hoor fitty dollars, and one Brown alg Was an accessory) twenty-five dollars or forcible entry and detainer under the stat- utes of Richard ist. Hoorsought relief by cer- ttorari, Which commanded the justices to cer- tity their record to the court; but in conse- quence of irregularity and defects in the record, the court arrested the proceedings. It is un- derstood that Adams may commence proceed- ings de noro to enforce the payment of the fine. At the Isst term of the criminal court Hoor was indicted for an sssanit and battery on Adams, and he submitted his case, when he offtred to show that Adams had insulted his wife: but this offer was objec’ to on the part of the prosecution, and the objection was sus- tained by the court. Adams subsequently withdrew the objection, and expressed a desire that the matter should be fully investigated, when Hoor was allowed to withdraw his plea, and the case gors to the next term of the court. The decision announced by Judge Fisher was as follows: This isa proceeding, not for the purpose of restoring to the relator the property of which he claims to have been possessed, but for the purpose of imposing a fine and imprisonment upon the defendants, and is based upon certain British statutes now of force in this District—a criminal and not a civil proceeding. From time immemorial private rightsin Eng- land, whence we derive our system ot juris- prudence, have theoretically at least been held in high retpect and veneration. When the common Jaw of Great Britain was in its in- fancy; when society was rnde and compara- tively unorganized, and when courts of jastica were more rarely open and less accessible and less facile in their forms of proceeding than the advance of civillzution has made them, mer were frequently constrained to rely upon the strength of their own right arms and the aid of their friends and re‘ainers to assert and maintain-their iudividual claims to the posses- sions to which by justice and right they were entitled. Thus the Jaw remained for a period of some ten years, when to meet the supposed necessi- ues of society and to edy the omissions in the former act, it was enacted by 15 R. 2, c. 2, that ‘on complaint of forcible entry, into lands or other possessions whatsoever, to the jus- | tices of the peace or any of them, the justices or justice take sufficient power of the county and go to the place where the force is made, | and if they find any that hold such place forcibly efter suck entry, they shali commit them to the next jail, there to abide, convict by the record of the sume justices or justice, until they make fine aud ransom; and that the people of the county and the sheriff shali assist, &c., on pain of imprisonment and fine.” This statute does not apply to the case of | forcible detainer merely where the entry was not forcible, but only to the ease of forcible entry followed by forcible detainer, and the justices, in order to haye jurisdiction for the purpose of punishing the offender, must act upon complaint, and must also, when they r- riye on the premises, find the offender still re- house. The third exception goes to the insuft- ciency of the record of the justices in its state~ ment of the offense. - This is equally fatal, because the record must show all the ingredients of the offense. The fourth and fifth exceptions are denials of the verity of the record, which, while we co not feel warranted in noticing them for the purposes of this case, inasmuch as they are contradictions of a record, not made under cath; yet we think proper to announce her@ thatif a case were brought before usy on oath of the defendant, setting forth tnat a justice or justices had act @ecorruptly or falsitied their record, we would not hesitate toerder him oF them before this court, and if, ona full inves~ tigation, it should satisfactorily appear that they had so acted, the proceedings would be quashed and the justices removed from office.
