Only* officers of the regular army (in- additional 2ids-de-camps appointed by the President, under the act approved Aurust 5, Ist1) will be detailed to muster into and out of the service of the United States, and no offic r will make these musters unless detailed to do so by competent authority. 113. Commanders of corps or departments will see that each regiment, independent com- pany, &c.. is assigned to some one of the assist- ant commissaries of musters ander their com- | mand. The commissaries of mus'ers will be Tesponsible to the adjutant general of the army for the correctness of the musters and muster rolls in their corps, and no officer shall | be mustered in, or out, except by a commis- sary or assistant commissary of musters to whom the command to which he belongs has been assigned. 114. No officer orenlisted man of yolunt-ers is properly in the service of tha United States, or autorized 'o receive pay, vutil mustered in by tle proper officer>and no efficer is properly out of service until discharged in Orders, or Tustered out by the proper officer. One copy ot the rolls or order in each case must be for= warded to the Adjutant General's Office. 1'5, Commisraries and Assistant Commis- saries of Musters, having been once detatled, will not be r-lieved trom this duty, or trans- ferred to another Division, Department, or Corps, without authority from the Adjutant General's Office. 120. The commissioned officers of all yolun- teer organizations, no matter whether estab- lished under the authority of a State or of the United States, will be rc garded as having been ccmmisticned on the qay when their muster into the service of the United States takes effect, and will take rank in their respective grades, will be entitled to pay and be obeyed and respected in their several positions from that date. 121 Mustering officers will muster into ser- vice and administer the oath of allegiance to such regiments or recruits brought to them as may present conclusive evidence of their ac- ceptance by the War Department. The following explanation to section 5, par- agraph 117, Mustering Regulations, (section 5, paragraph 8, General Orders 48, of 1853,) is anrounced for the information and guidance of ali concerned: ‘When an enlisted man or officer receives & commission or appointment advancing him to a higher grade, and has not an opportunity of being mustered in co as to appear on the next muster ros as ‘of the gr: to which he is commissioned or appointed, he shall be mus- tered on the next muster rolls in his proper: grade, according to previous muster-in, and a remark to the following effect made on the muster roll opposite his name: Received com- mission (or appointment) from the Governor of the State of —, as in the — Regiment of — Volunteers, on the —— day of ——; waiting muster- in since that date. The lasteentence of section 5, paragraph 117, Mustering Regulatiors, edition of August 31, 1863, commencing “If on the muster,” &c., shall not be so construed as to prevent the muster- in, by the Mustering Officer, of officers so mustered back to the actual date of receipt of commission or appointment, if it be not more than two montas beyond the ee at which they appear,-as above, om the rolls. * Exception in cases of necessity will be made upon application to the Adjutant Gen- eral, Washington, D.
