By Mr. Bradley.—They spoke in English, of which the witness understands bat little; bat & young man was present [at the time of the Sept: mber visit.— Rep.] at the time, and acted as interpreter. The lady spoke English, which was interpreted to her. C. E. Creecy recailed by Mr. Davidge.—Wit- ness went to Aliot’s with Miss Susan Dixon, but Mons. Aliot was not present. Mme. Aliot resent, and Mme. (ass Susan) was not the raid, who was fatter and demand to ha patties confronted. Mr. Davidge said Mrs. Aliot saw Miss Wat- tie but once, and on that occasion did not re- cognize her as the would be thief. There was no doubt but that an atiempt had been made to steal a braid by some one in company with Mr. George W. McGill, but the crime of McGill 19 Aggravated tenfold in that he takes advantage of the fact, and for particular -purposes foists the crime upon an innocent girl. he charge, therefore, is not false in all particulars. Some one in Mr. McGill’s company did attempt the theft, but it was not Miss Susan Dixon hat contempt and disgust must necessarily be feit for a man who will act thas. In the whole course of his experience he never knew a case which more required condizn punishment, and he therefore asked the justice to fix such bail as would secure the prisoner's attendance at the bar of justice. Justice Clayton reserved his decision until this morning at ten o’clock,’Mr. Niles still re- maining bondsman for Mr. McGill's appear- ance at that hour. This morning Justice Clayton'decided to hold G. W. McGill to bail in the sum of $800 for his appearance at the present term of the Criminal Court. Mr. S. V. Niles gave the required se- curity. SEE ane Forp’s New THEATER — Maggie Mitchell's Benefit_—This accomplished lady has a benefit this evening, appearing in two of her best characters. She will be well supported by Mr. Ford's talented company, and also Mr. and Mrs. Bishop. The plays selected tor this even- ing are «Katy O’Sheii” and “The Pet of the Petticoats,” in both of which Miss Mitehell has ever Leen eminently successful. The beauty of the new theater and attractiveness of the night's performaace will no doubt attract a large aud appreciative audience to Ford's. No attraction, however great, seems adequate to interrupt the flow of patronage at this establishment, and the tide of popular favor seems stroager in the support of Ford’s theater than ever. By Mr. Davidge—Within seven months McGill has been attentive to Miss Susan. (Objected to.) The interpreter gave as Mme. Aliovs reason for thinking that Miss Susan was not the lady who took the hair, that her general appearance was different, and that the person had rosy cheeks. By Mr. Bra@ley.— Witness does not recollect how Miss Dixon was dressed when she went to Aliot’s; but thinks she was dressed appro- priate to the season, or he would have re- marked it. He never was so much attached to Miss Dixon as to notice her dress particularly. He generally noticed a lady’s features. [Laugh- ter. It was & base attempt to blacken the character of an innocent girl, and he asked that the defendant be held to answer betore the proper tribunal. Mr. Kradiey said that this was a question involving peculiar circumstances; and he could not but believe that Mr. McGill was justifiable in the course he had pursued. He (McGili) thought he was dealing with a lady for whom he had an admiration, and he supposed that udmiration was reciprocated; but because he felt it to be his dat to tel this lady of her sis- ter’s shortcomings he was scorned, and in self- justification he wrote a plain and full state- ment to the fatherand mother. He (Bradley) believed the facts as contained in the letter were strictly true. But the refdsal of the court to allow Miss Wattie to be confronted by the Witnesses shut the defense out from positive | proof, and he was therefore pained to report, as his solemn conviction, that he believed the facts to be strictly true. He appreciated the position of the unfortunate lady, and would do nothing to unnecessarily wound her feelings; but he woald be false as an advocate if he di not detail the facts as they occurred. Mr. Bradley then proceeded to review the tes- timcny and the letter (published in yesterday's Star,) and argued that all the facts were main- tained by witnesses, who could not have been in collusion. The statements of Mr. and Mrs. Aliot were clear and to the point; gnd although Miss Wattie was a pale lady, yet’even the last witness admitted that even a ‘consumptive might have bad a color on her cheeks from a Jong walk at that season of the year. He (Mr. Bradley) felt himself hampered, because in his remarks he did not desire to wound the lady’s feelings. He only stated that he did so that all might know that he (Mr. B.) believed the case fully made out, Mr. Davidge in his remarks expressed sur- prise to hear Mr. Bradley say there was proof of the crime. It was a common thing forcoun- sel4o enter into the feelings of their clients, but Mr. Bradley was unnsually zealous. Mrs. ‘Aliot testifies that the lady who attempted the theft had light hair and rosy cheeks; and when Mies Wattie goes to Mrs. Aliot, the latter could pot iden’ her as the person who attempted the theft. The most striking feature was that whiiethe defence brought Mr. and Mrs. Aliot here, Mr. Bradley did not at the proper time demand that Miss Wattieshould be confronted by them.
