The Navy Department has received informs- tion of the capture of the schooner Flying Scud by the steamer Princess Royal, on the j2th uit, She was from Brazes, Texas, and loaded with cotton. ¥ ‘The U.S. bark Gem of the Seas, on the 3tat ult., off Charlotte Harbor, Florida, captured the sloop Richard, of five tons, loaded with eight and a half bales of cotton. BBSULTS INDECISIVE. eee Crscrns att, Sept. 31.—A special to the Com. sercial gives the following account of Satur- Gay's fighting: The baitle opened at 11 o'clock, in the vicinity of Widow Gienn’s, on the road leading from McLamore’s Cave to Chattanooga. It soon decame general, the enemy maneuvering his troops finely. Early in the action the rebels made an im- Petuoue charge on the famous Loomis Battery, when five out of the six gune were captured. Capt. Van Pelt, commanding the bat taken prisoner. At two o'clock the contest be- came terrific. Theroll of musketry was far mor continuous and deafening than at Stone River. At 240 o'clock the division on the cen- ter was hard pushed, broke and retreated. Col. Barnett planted a batiery, and soon cheeked the pursuing enemy, who, in retura, was Griven in disorder over the sams ground, Davis’ division was driven back with heavy lose. Every gun of the Sth Indiana battery was cxptured; when his forces rallied pushed the enemy back, and retook the guna, Reynolds lost heavily, but stubbornly held bis position, driving the enemy, but never leaving his line. Palmer, who was overwheimed, failed to cet off his entire battery, and asa consequence, two of his guns were lost. Van Cleve, fighting gailantly, lost ground, and being overpowered, failed to regain his Position. Our line was pressed severely, and wavered: The rebels, exulting over the apparent succasa, mede the air regonnd with cheers. They ad- vanoed slong the whole line, and when within fire, musketry rolled from right and left, and ‘until Hve o’clock the fighting was terrific. be General grew anxious. The wounded began to pour in, and the rebels steadily moved up near bis headquarters, New forces were oppesed to them, and from this time until dark the battle raged with destructive fury. At dark, the firing having almost ceased, the enemy threw forward fresh troops, and egain engaged our right. The xction became general, and ontil long after dark raged with fury. The battle thus farisa bloody one. Our loss is verygreat. Wrisoners say some of their reg- iments are almost annihilated. Seas Crimimat Cot The special term of the Criminal Court was commenced this morning, with Judge Fisher presiding. A goodly num- ber cf attorneys and spectators were presant. After calling the grand jary, Judge Fisher announced that an act of Congress provided that each of the jurors should subscribe to the oath of allegiance. The oath was then admin- istered to them. Wm.
