LOCAL NEWS. AMUBBMENTS TO-NIGHT, WASHINGTON THEATER.—There was a good audience at the Washington Theater last night, and all in attendance manifested delight at the performances of the St. Dennis Troupe. The entertainment consisted of graceful dancing, amusing pantomime, good singing and fine performances on the tight rope. Another enter- tainment will be given this evening, all the members of the tronpe appearing. Tue Case OF Witgy ys. Brown—Circuit | Court, Chicf Justice Cartter.—Yesterday, in the case of Mrs. Emily F. Wiley ys. Marshall Brown, Mr. Brent, cne.of the counsel for the petitioner, closed his argument, and the counsel tor the defense asked thatthe following prayers be granted: The counsel for the petitioner, in closing the case to the jury, having maintained that the entry in pencil in the New Testament, made by T. P. Brown, the attestation by said Brown to the certificate of D. Condict, and the postscript to the Jetter written in Ist}, and the interview with Cartlitch, are evidence from which the jury may infer his acknowledgment of the said Emily 2s his child to legitimate her under the tute, the counsel for the defendant prays the ourt to instruct the jury that inasmuch as all these incidents occurred before the marriage of | the parties they are not evidence of any ac- knowledgment under the stature. And further, the said connselin their closing argument baying urged to the jury that the counsel for the defendants have given no evi- dence to show where Elizabeth Brown was nine months before the birth of Emily Wiley, | or as io her haying had intercourse with other | men about that time, the counsel for the defen- dant prays the court to instruct the jury to the | effect following: That the petitioner haying in her evidence-in-chief confined the period of | the sexual intercourse between the said T. The Court has opened the broadest latitue to proof, with & view to the thorough investigation of that su’ t, and bas deter- snined, mong other things, that this Testament, uns letter, and the signature of Brown to the certificate, were competent items of evidence. They are competent as far as they haye any agency to show who begot Emily Wiley. They are not competent, under the statutes of Mary- Jand, in giving Emily Wile the legitimacy which @ posterior marriage gives toalegitimate child, The Court does not notice particularly the argument in this behaf, but it this intend- ment was given to those items of proof, it was wrong. Mr. Brent.—I neyer so contended may it please your Honor. The Court—No, I do not know that you did. The Court merely says tothe jury, you will reject these three items with reference to the acknowledgment of Emily after tne marriage— the acknowledgment made necessary by the itute of Maryland to legitimate. The second proposition relates to a supposi- | ‘uous case—not exactly that either, for itisa case that has been made in the testimony, al- though the controversy and the tesiimony are addressed to your responsibility and not to mine. The Court will, therefore, charge you that if you find from the testimony of Mrs. Brown that she made the acquaintance of Til- dorson Brown, and conceived of him a child | within the first three months following the | fourteen months previous to the birth of that child, the burden of explanation, the burden of proof, the responsibility of enlightening you in reference to the place and Lime where her child was begot rests upon the plaintift and notupon | the defendant. Thereason of thispresumption lies here: that the first three months pre-exist- ing the birth of a child makes it impossible, under the well-known physiological laws, that | the child could be the offspring of the party who cohabited within that period. And the explanation that may haye succeeded it, as far as there is any responsibility about it in the case, devolves upon the party that wishes to es sh the conception. This is all matter of tact for you, gentlemen; this presumption, however, is a presumption created by the law. There is no donbt of it. Where a party makes prcef of a fact outside of what they have got to prove, tbe other party cannot be called upon to reply to it, because it does not raise a case, and if they would explain it, or have it explained, | the responsibility devolyes upon the party for whose benefit the explanation should be made. That is the simple explanation of it. Butin this the Court does not attempt any opinion about the tacts. Itdves not intend w do so. The Constitution makes you the triers of the tact, and responsible under your oath in the judgment of the facts. It isthelaw with which the Court bas to deal. The idea of the third charge, as the Court understonds it, is this: In estimating the value of testimon s laid down as a principle of the law of evicence that a departure in detail, me and circumstance—which are subordinate ihe main subject of testimony—is not a mat- ter of impeaciment to the witess. On the other bend, where there are many witnesses involved in the single case, the law pronounces this divergence o1 detailed memorandum in reference to incidental tacts as a corroborating crcumstances of honesty on the part of wit- uesses. On the other hand, contradictions as | to the main body of the proof to which wit- i] nesses are called, and not the incidents, are estimated as of a different character. They have there to be reconciled, or you haye to overrule one version and adopt the other. The counsel for the petitioner asked the fol- lowing additional instructions, which were granted: 1. Acknowledgments prior to the intermar- riage testified are compeient proof on the issue Of paternity, but are not to be considered as ac- knowledgments under the statute of Mary- iand, which must be made subsequently to the Tiage, Itis for the jury, u mn the whole evidence, to ascertain whether Emily Wiley was con- ceived in Washington from an intercourse with T. Brown, or in Baltimore, or elsewhere, trom an intercourse with some other man; ‘ted it is for the jury to find the meaning and interpretation of the testimony of the witness . McDonald was tried for committing a rape upen a Mrs. Feige, but the jury were anable to agree upon a verdict. Yesterday morning, Mary Taylor, indicted for keeping a disorderly house, submitted her cause, und was fined $25 and costs. EH SE , A Row in A ResTauRanT.—Abont 6 o'clock yesterday evening, a row occurred in the lager beer and wine saloon of P. Hermann, on Fourteenth street, near D, between three sol- diers of the Tenth New Jersey volunteers, and Mr. Hermaun and wife. The two latter had their heads cut by the soldiers. A great number of persons were attracted to the spot by the yells of Mrs. H. after a soldier had un- gsilantly knocked her down. The Second Ward police arrested the soldiers and locked them up. CoMMITTED TO THR OLD CaPpiTroL.—James Gaines and John McCall, belonging to Ashby guerrillas, and suppcsed to be horse thieves, Were sent to this city yesterday,and committed to the Old Capitol prison . H. Lynch and Ambrose McWilliams, suspicious characters, “were also sent to the city and committed to the Old Capitol. Officer Stuard went to McG.'s with the parties, and he refused to give the horse to the Lientenant, alleging that he had previously bought it, but consented that the policeman should take charge of it. McG. was arrested, and on Wednesday hada hearing before Justice Dury, who held him to CHARGE OF STEAL day John Clagg, a discharged soldier, was lying asleep in the Western market, when he was roused by a hand in his pocket, and miss- ing his watch, he charge¢ & man named Glas- cow with stealing it. snd threatened to whip the soldier, and while an altercation was going on between them, Glascow went off. Clagg went to the police office, ard haying described Glascow, Officer Stuard arrested him, and he was by Justice Drury held in security fcr court. ———— Caveut A NarPinG.—At an early hour this morning, Mr. Luckenbac and his brother, No. 5iS Fifteenth street, were aroused by a noise in their kitchen, and asearch revealed a negro named Edward Miller, asleepina chair. A lot of tools, ten shad, aham, a lot of shoes, &c., were found in an old wagon at the rear of the house. The goods were identified by v: ous persons, but there was no positive that the negro.put them there.
