The evidence was, that while Sam was stooping on the wharf the priso- ner walked up behind him an t pushed him over board, leaving him to struggie in the warer: that parties on the wharf attempted to recene fim, but without success. It was als evidence thatthe prisoner said he was to push a Mr. Wise overboard, because Mr. pushed him in. The prisoner, it seems, hud been drinking hard, and after his arrest showeid evidences of manid-a-potu.
