While Mr. Dean was thus addressing Hall, Marshal Lamon came in and took a seat, when Dean inquired if he nad & process. The Marshal replied that he had a paper in his hand relative to the case, but he did not conie to serve it himself. He merely came there as an officer of the court, to iaform the military authorities that Mr. Watter S. Coxe had been appointee: by Judzes Cartter, Fisher, and Wylie, & commissioner under the fugitive slaye law. The warrant was directed for service to Mr. Joseph S. Worthington, who was here introduced. Mr. Dean said he was surprised that any appointment had been made under the Fugitive Slave act. This matter must be brought again to the attention of the Court. Marchal Lamon suggested that obedience to the warrant would bring the matter up on a habeas corpns. Mr. Desn did net see how a commissioner could be appointed, when the slave law did | notapply to the District, and he hoped Judge Sherburne would not rec: ize the warrant. He (Mr, Dean‘ had a right to deny entirely the right of the commissioner to issne the warrant after the fugitive had been once released. Mr. Lamon said he had done what he came there for, viz: to inform the rajlitary authori- ties of the appointment of the commissioner, and that was all he had to do with the matier. Mr. Dean then addressing Major Sherburne as “ Judge,” and “your honor,” &c., demanded that the negro be remanded to the custody of the military guard. and there retained until Monday at 10 o'clock, when he would have the ease brought up again: and in the mean time } would find out when Mr. Coxe had been ap- pointed commissioner. But he did not want the boy to lay in jail any longer. Mr. Dean then lectured the boy how to act and told him not to attempt to run away from the soldier, and turning te Mr. Worthington, he said the boy was under military protection and he would allow no process. He did not | Want tosee again such a row as was attempted at the City Hall yesterday. After a short interview with Marshal Lamon, Major S. returned and handing the warrant back (o Mr. Worthington, remarked, the boy was In military custody and therefore the war- rant could not be recognized. He would send the boy to the Contraband Camp. Mr. Dean said that he proposed on Monday merning to present this matteragain, andif the Court decided that the law of 1S50 applied to this District, he, as alaw-nbiaing n, would surrender. He proposed to make this a test case. Mr. Dean was very much concerned lest Mr. Worthington should attemptto arres: the boy after he had been seni to the camp and was not under immediate military control.
