C. Barney be adjudged unfit to actas ‘dian of his ¢ dren, and quoted Justice Story and others to show that on a bill being filed in chancery the one had aright to interfere until the question wes decided. Since the proceedings in the Uir- cuit Court, Mr, Barney bad taken possession of the children, and yesterday afternoon carried them to Baltimore, beyond the jurisd: tion of the court, and in contempt of both cou and he asked that before Mr. B. was permitted to bond, an ordér be issued that the children be brought into court. F.P. Stanton tollowed Mr. Cox, reviewing the decision of the Circuit Court, and conten: ed that action im the case should be suspendec un‘il the courts could be reorganized. Mr. B had shown his contempt for the court whiie the case was pending, by taking the children from the guardian appointed by the court, ind now comes in to be appointed to the guardian- ship. Under the circumstances the prayer should be refused, or the case postponed until the childreu be brought before the court. Mr. Davidge said that this was an age of ‘Wonders, and the arguments advanced were extraordinary. He asked if he could, by filing @ bill im_chancery, deprive a man of his chil ren! The children, he contended, did not be- come wards in chancery until the order of the court was ed. He then reviewed the case, and contended that Mr. Barney was the rizht- fal custodian of his children. He contended that. the Sage now before the court was ‘whether Mr. Barney would be allowed to give bond, not asthe guardian, for he was already the natural guardian of his children, but to accord with usage.
