The prosecution failed to prove you ordered any thing; the testimony only showed you opeued a correspondence with the Government contractor to know of him if n individuals could be furnished with coal at Government prices in regard to the issaing of the warrant. that was done solely at the instance of Mr. Benjamin P. Smith, counsellor for the platntif’s. L cannot sce why Squire Cull if he will not do it, L will put aman in bis place that will do it.” I could conclude nothing less than that the counsel for these parties had made the cow- plaint that 1 had been applied to for a warrant, and had refused to issue one; bence the remarks wade by the Mayor, a3 narrated by Mr. Smith to me. However strange it may appear, after all this, his complaint to tue Mayor, lis positive belief the law bad been grossly violated, and his connecticn with the plaintiffs as their counsellor, and being timely notitied of the hour of trial when the officer notified him of that fact, he stated to the officer he had nothing to do with the cuse Since the trial, the officer in the case (F. elin) stated to me that he (Smith) had stated to bim on last Sunday morning the remarks us narrated to me by Mr Smith as being made by the Mayor. In conclusion, 1 would say that it was at the instance and upon the information of Mr. Benj. P.
