ARREST For Cartix STEALING —This morn ing, Officer J.T. King arrested a man named Allan Fleetwood upon a charge of stealing three heifers, the property of W. H. Rowland, of Prince George county, Md. The case was taken before Justice Donn, and Mr. Giberson aj for the prosecution and Mr. Carri for the de- fence. It appeared from the evidence that the cattle were taken from the field near Mr. Row- land's — on last Thursday week. On the Friday fol owlng, @ young man formerly in the employ of Mr. Rowland for two years and eight months, and who knew the cattle, saw them in Mr. Geo. Miller's slanghter pen inthis city. He asked the agent where he bonght them, and he told him he got them from a man naietl’ Brooks, of Prince George, and gave $21 for hepposrn 4 Were worth about $50. Georgetown. He went there, and asked for the hides obtained from Mr. Miller. They were shown him, and he instantly recog- nized the bides of his cattle by the ear and flesh marks. The young man who had seen them in the pen identified the same marks. ‘The ears were cropped. and there was a hole in the right ear and a slit in the left car of each heifer. The agent of Mr. Miller identified Fleetwood as the person from whom he purchased the cattle. The prisoner told a straight tale, and deceived him. He said he had come to the city for guano. and offered the heifers for $50. The agent told him he did not want to buy. Fleet said he would hardly take them back for them, and asked what the agent wonld give. He replied, he would give $21. Fleetwood (or Brooks, as he then called bimself,) went off a little way. and went back and ssid he would take it, rather than carry them back. He also said he had some sheep, which he would like to sell if he could geta fair price. The agent told him that be would give him the mar- ket price. Another butcher, to whom he promised fo sell seven wethers and a number of lambs,went to Uniontown on the day appointed, to wait for him, but he failed to come. The agent of Mr. Miller saw him in the market this morning, and asked him about the ss but Fleetwood pro- fessed not to know him. Witnesses were cer- tain this was the person. Mr. Kirby testified, for defence, that this man worked ou his mother’s farm, adjoining his own He made baskets at times, and had borne a fair reputation. He lives in Alexandria, but works in Maryland. Mr. Carrington argued that it had not been shown that a larceny was committed. The cattle being at large in an open field by the roadside were notin manual or constructive possession ef Mr. Rowland, and the charge of lar: eny was not sustained. He also argued that the offence, if one, W2s committed in Prince George connty, Md., beyond the jurisdiction of a justice of the peace of this county, and therefore claimed the dismissal of his client upon the ground that the justice had ho right to commit for trial here when the offence was ged pose beyond this jurisdiction. Mr. Giberson stood pon the duty of the juatice tocommit for trial where the evidence slowed probable cause for belief of the guilt of the party. As to the evidence, it was conclusive. ‘The heifers are identified as Rowland’s; they are found at Mr. Miller’s, traced to the possession of the prisonet who bronght them there, sold th there, and ceived the money for them. Even if the o: € Were not committed in this jurisdiction, it would he the duty of the justice to cominit the prisoner to jail to await a requisition. Justice Donn decided that the evidence was nt to require bail for court in the sum of S500, in default of which Fleetwood was com- mitted to jail. ‘The prisoner 1s an elderly man, of small stature, and appears to be a er.
