City Covuxcits.— Board -of Aldermen.—The board met at 4 o'clock, p. m., yesterday, the pres- ident, W.'T. Dove, Faq.. in the chair. A communication was received from the Mayor Teturning unapproved twe bills, one entitled “An act anthorizing the erection of a market-house in the Seventh Ward,” and the other “An act for supplying the shat, Sp Asylum with water, and to protect it against lightaing.”” Mayor s in giving his reasons for the veto, first states, in that the charter of the city has provided us with a government in which the legislative and executive ctions are Mongo Pia arated and defined. This distinction, he holds; is of vital im ace, and should be scrupulously observed. That we had ne legal to act, or to bind in any respect the = of this city, eithet in or property, otherwise than in ac- cordance with the fandamental principles of the organic law. Hf those ordinances (the vetoed ones) were fonnd. after careful consideration, to be re- pugnant to those fandamental truths, the Councils would. he was confident, agree with him that they ceuld net become the law. He states that they are backed in some sort by precedent, but, notwith- standing that. they had no more authority than that which belonged to them, as ineasnres adopind without any attention having. at the time, been drawn tw the objection now made; and, convince as be is that the objection he now makes js radical and insuperable, he cannot consider it asa part of his daty to recognize any such precedents. ‘The act authorizing the erection of a market- bénse in the Seventh Ward the Mayor objects to because the second section makes the execution of the work inconsistent with the ottice and duty of tht Mayor. It reduces that oifice to a mere cipher in several particulars. Its scheme was to make the Mayor ons of a bedy of those created for the oc- casion to cause to beexecuted a law of this Fe om atlon. Mr. Smith hoped that such a course would not he taken. He had great respect for the opinions of the Mayor, but at the same time he had the fullest confidence in the common sense of the two boards. and their capability of legislation within the provisions of the charter. He took the ground that the two boards had the power to appoint the Mayor to act in conjanction with a committee of them to discharge the general duties connected with any temporary matter. There was an im- portant question involved in this matter, It was that the rightsef the two Boaras should not be curtailed by any assumption of dignity or of al- leged invesion of executive authority. This bill for the Seventh ward market-house, provided that it was to be built by the contract awarded to the lowest responsible bidder, and it was for the Counrtls to see those provisions carried out in conjunction with the Mayor. He held that it was competent for these boards to appoint joint committees. No joint committee could be a committee of the Corpora- tiom unas the Mayor was connected with it. Tarton, T. P. Morgan, and Charles Abert. &. S. Parker, Faq , a member of the present Countil, declined a nomination. Messrs. Andrew Carroll, 8.8. Parker, William Gribble, Solomon Stover, and Terrance Drury, were elected delegates to the city convention.
