In rue Cinctit Court, a case of great interest has just been decided; and we depart from our usual custom, so far as to publish theentire case, that our citizens may see the extent of the protec- tion they have against the negligence of our city autborities in regard to the highways, bridg+s, streets, &c , under their charge and care: RC. Weightman agt. Corporation of Wash- ington —The declaration was in the usual form, charging the Corporation with the duty of keep- ing im repair the bridge over Rock creck, at K street; and that, on the 20th May, Is54, the said hiidze was in a dangerous, unsafe and rickety conditien, by reason of the default and negligence of the said defendants; and that the said plaintiff was then and there, to-wit, on the day and year aforesaid, at the county aforeszid, lawfully pass- ing and crossing over Said bridge, ina certain commoa acd ocdinary vehicle, and while so ing and crossing over said bridge. by reason of its rickety, unsafe and insecure cordition, and the default and negligence of the said defendants, then and there broke, gave way and fell in; by reason of which said breaking, giving way and faliing in, the plaintiff was injured, &c- plea was, Not Guilty. On the trial, the pill of exceptions was taken: On the trial of this cause, the plaintiff, to matn- tain the issue on bis part joined, read from the charter of the city of Washington (it being agreed that either party might read therefrom as evi- dence such parts as be might deem pertinent to the issue=) the thirteenth section of the charter of 1390, as follows: * And be it further enacted, That the levy court of the county of Wasbington, in the Disirict of Columbia, sball not possess the power of assess- ing Soy tax on property in the city of Washing- ton; nor shall the Corporation of the sa‘d city obliged to contribute in any wacner towards the expenses oF expenditures of said court,except for the one-half part of the expenses incurred on ac- count of tbe orphans court, the office of the coro- ner, the jail of said county, and the opening and tepalring of roads in the county of Washington east of Rock Creek, leading directly to the elty of Wasbiurton; but the said Corporation shail have the sole control and management of the bridge across or over Rock Creek at the termi- nation of K street north, and shall be chargeable with the expense of keeping the same in Tepair end rebuilding it when necessary.”? And then, again, evidence to show that the plaintiff then and now was a citizen of said city, Was returnins from Georgetown to the said city on the — day of May, It34, and riding in one of the emnibuses running between said cities, and while, cressing the said bridge, in said omni- bus, with the plaintid therein, was Precipitated into Rock Creck, whereby he (narrowly escaped drowning) was seriousiy bruised, his left arm broken, bis left hand crushed insomuch that the said hand has been rendered uselens for life. ‘That he was confined thereby to th+ house fora long time, under the care of the best medical at- e 1 re. and during the whole of sid period of time suifcied great bodily pain ; and rested And thereupon the defendants cttered and gave evidence to show that in the year 1899, a certain ordipance was passed by the authorities of said city as follows : [Here follows the act of the Cor- E ation authorizing the construction of en :ron cidge over Rock Creek at the western term 'na- tion of K street_} ‘That ia conformity with said ordinance, a committer consisting of the Mayor of the City ef Washinzton and two practical and scientitic Workers in iron were appointed; that the pan of said bridge was approved by said co.nmittee, and that they acted in yood faith and with a view to the erection of « bridge adequate in plan, prin- ciple, strength, solidity and constructien to the Rurposes for which said bridge was required. And thereupon the plaintiff, to rebut the evi- d-nceso offered on the pert of the d-fendant«, gave evidence to show that the same Scientific nen, whose opinion was so, ax aforesaid taken by the defendants, stated to the defendants, at toe time be was so consulted. that the plan of the said bridge was 101 feet, and they submitted the plan to bin, and be said the principle was correct, but it would not bold out indefinitely with iron bridges; that the said bridge isan tron bridge. cons:ructed on the plan of Rider, (patented,) and built by Rider bimself; but the arch of said bridge was bigher than bad ever been attempted, (a single span of 110 fret,) and when Rider bad con- tracted to build this bridge, be objected to, and remenstrated avainst, building the bof the bridge so high, but the defendants required it to be dune in oder to accommodate the Passage of canal boats, tbe said bridge being constructed, over the basin of the Chesapeake and Ohio Canal constructed, ia the saidcreek; and said Rider believes the said ee fell by reason of the said arch ther of being raised so high That they fortuer gave evidence by one of the said committee that he had not been consulted originally about the plan of said brid, e, but at that time he believed it to be a yood plan; be is now satistied from further study aud experience toat It was essentialiy, radicaliy defective. He further gave evidence to show by another skill- ful and seicutitic worker in {ron that after this bridge fell be was employed by the Corporation to examine certain other bridges built by said Rider for defendants on the same principle, ex- cept thet the arch was much less and the span not near so great, and his opinion was at once formed that there is in the plan an inberent vice Which makes every such bridge not horizontal unsafe and insecure, and as the arch is increased that tmsecarity is increased; that within a year after the said bridze was rebuilt, the defendants changed the approach to said bridge at each end by raising the same aud extending it upon the biidge, aud thereby adding above three tons to its original weiy bt. And further gave evidence by said commis- siouer of the First Ward that be crossed said bridye, a few days before it fell, and it was so tremulous and shook so violently, that he was apprehensive it would fal!; and furtner evidence, by divers persons. that, for several days before the said bridge fe.l, they Lad observed tua’ «ev- eral of the braces of said bridge were broken, and some of the wedges had fallen out, and the bridge was loose; shook greatly when carriages passed over it; and rested. M. Strakosch, with a view to the wants of the patrons of music here, furnished them with a programme comprising some of the best productions of the old and the new compo- sers, which have never before, to our recollection, been — ia concert by any com; which bas appeared in Washington. At the c! of each Piece, the performers were vociferously encored; anid, after, the audience became so enthusiastic asto break in u the singet with a storm of applause in the midst of the song. Several pieces in answer to the persistent de- mands of the audience were repeated, and the utmost delight was felt by all at the exquisite rendition of some of the musical gems of Meyer- beer, Mozart, Rossini, Donizetti, Verdi, Mendel- sohn, and other great composers. Such a greet- ing es this great company received from the best people of Washington last evening cannot but prove highly gratifying to them all, and demon- strates fully the question whether a first class performance by any company will not receive its due meed of support by a Washington audience, albeit the prevailing feeling in favor of mal- a@ppropos applause To-night, this company takes its farewell of our citizens, and we advise all who have not en- gaged tickets of admission-to do so if they ex- Pect to find seats in the hall. Tae Nimacx Sixrexce.—Stinemetz whoderis altogether on the principle of many and quick siles with the smallest modicum of profits, is doing a very large share of the Washington City trade of this season in furs. Hix stock bas evi- dently been laid in to the end of accommoditing the means of all, the most economical in their expenditures, well us those who can afford to indulge in furs of the most expensive and luxu- lous description. Ladies will fiod genteel sets of furs there at from five or six dollars up to one hundred dollars, if not higher. For our part, we hardly know which most to admire—bis cheap but genteel and useful and comfortable furs, or his expensive ones. There is so little dif- ference between the appearance of cheap fats and very costly ones, that one must be a bet- ter judge of such things than we are to tell them readily apart. For Courr —Yesterday, a case was tried be- fore Justice Donn, that will probably cause some discussion in the Criminal Court It appeared that N. Larhne bad disposed of his Segar store to Mr. Cohn, and, two days afterward, forced his way inte the siore, drove out the purchaser's agent, took the money from the drawer, and locked the decor. Officer Busher was sent for, and he sne- ce ded in arresting the accused, who was taken before Justice Donn, where the trial was had. Messrs. Giberson and Thompson appearing ax counsel for the parties. The contract was exhib- ited and a disposition to argue the validity of the plaintiff's possession was manifest ; but the Justice decided that the evidence was sufficient to justify a commitment for Court, and the law points would be properly argued there. Burotany —Last night, the plumbing estab- lishment of C. Snyder, in the Philharmonic Hall building, near the Stac office, was burglariously entered, and a couple of pieces of copper, worth about $30, stolen therefrom. An iron rod, which Lad evidently seen service asa respectable fire poker, was made todo service in forcing the Front door, and was left bebind by the thieves. No clue to the perpetrators bas yet nm discovered ‘The concert in the upper portion of the building did not close until a ijatehour. The rogues must have waited until the hall was deserted before they plied their trade. A New Gas Buryer.—The gas burner adver- tised in the Star by the agent of Mr. Gleason, the patenire, seems tous to be no humbug, but a pos itive preventative against the eseape of more yas than the consumer desiresto burn. We haveone in operation ta the Star office, which, so far, does all the agent aforesaid claims that it will doin the way of decreasing tbe consumption or escape of gas while increasing the intensity of the light. As the experiment can be made so as torhow the operation of this burner ina single minute, we advise all desirous to lessen gas bills to call at Miller's plumbing and gas fitting establishment and test its operation for themselves. Mr. Granbery bas for the Past vear been in charge of the Southern Metho- dist Church on Eighth street, in this city, and is now atthe Virginia Conference in session at Portsmouth. A few weeks since he joined his fate to that of 2 fair lady from a not iar distant region. Accipent.—It was reported at the City Hall, this morning, that a hack in which Mr. Ebbert and his daughters were seated, while passing along New York avenue, between North Capitol and First street west, was overturned atacut in the road where an excavation of about twelve feet depth had been made while the improve- ment of that avenue was in progress. The coach was smashed and the horses injured, but the in- formant thought the inmates were fortunate enough toescape. The ward commissioner im- mediately started to the spot designated. to take measures for the prevention of similar accidents in future The best preventive will be the speedy completion of the work on that avenue; and we understand that it is now under contract, and will be immediately commenced. ‘Tux AsyLuM.—We learn from the intendant, J.R. Queen, Esq., that there are fifty-eight in- mates in the workhouse and fifty-one in the alms- house. The former are kept at work by various means, the stronger in erecting a new ice house, and the feeble in lighter jobs onthe farm, Wm’. Dism ssep —Yesterday, a colored man named Andrew Dogan was arrested by Officer Ross on suspicion of stealing $10 in gold. The case was carried before Justice Donn, when the evidence appearing to be insufficient, and proving an ex- cellent character, he was dismissed.
