On the other baud. the counsel contended that the defendant bad uot been in legal possession of tbe premises; that be bad given up the Key to the agent, after which be illegally forced bim- self into the house iu the night time. The agent in endeavoring to eject bim hed had a difficulty with bim, and bed called upon the watch for assistauce, and they bad taken bim to the watcb- house, where he hed been detained all night un- der the above charge. He Tequested that tis case inight be tried before Justice Thom yn, and Was accordingly brought to the Fifth district lice office.
