Tan Jury Qvestion.—All reading men among us know well that. out of South Caro- lina, trial by jury in criminal cases in this country has become little else save the loop- hole through which, in too many cases, the guilty may escape. We point proudly to the action of juries in our own midst, of Iate, as an exception to this general rule; tor whieh, by the by, may we not, after all, thank the reck- lessness and violenee of offenders against the law, who bad come to carry matters here with so high a hand as that no juryman felt eafe to walk our streets o’ nights? The violence of the disease has worked its own remedy in our midst. Nevertheless, we recognize the neces- sity of a general reform in the manner in which American juries discharge their fune- tions. Recognizing that necessity, we commend to the reader the following reflections and sug- gestions of the New York Commercial Adver- taser: Tar Jury System —Lord Chief Justice Camp- bell, as our readers are aware, has given notice that he will introduce into the British Parlia- ment at its next session a bill dispensing with the necessity for a unanimons verdict of ajary, and making the verdict of a majority of the jury ® legal conviction or acquittal. The pro d change wilt, doubtless, be stronzly opposed in Fagland, and perhaps for the present the move ment will be unsueressful. The English people are not only ‘‘not given to change,” fur pre- verbial for opposition to all radical changes, and cling to time-Bonored institutions with wonder- ful, and sometimes amusing pertinacity. And even Lord Campbell, with his acknowledged learning, purity and experience as a judge, will find bis courage and perseverance taxed severely in the prosecution of bis avowed purpose. That the tories, the ultra conservatives, of the country Will oppose such an innevatioh, may ve very nat- urally expected ; but it seems by no means im- probable that the Radicals, also—the party who claim to be especially reformers—wi!l make « very strenuotis yp rere to the proposed change. he subject is destined to be gravely discussed also on this side of the Atlantic, for disagree- ments by juries are of much greater frequency here than in Eagiand. It is not trial by jury, however, that Chief Justice Campbell on’ that side of the Atlantic or reflecting men on this seek or will seek to abolish. Nor would reflect- ing men consent that a man’s liberty or life shall be perilled or placed at the merey of 2 bare ma- jority of a jury. The aim is to secure to the per- son on trial and to the prosecution all the advan- tages of atrial by jury. without imposing upon the jury themselves those onerous burdens to which at present they are subjected. In England, the law allows the judge to bold a jury in duress until they agree upon a verdict, and authorizes him to resort to some severe and almost barbarous expedients to enforce such agreement. This Practice does not prevail bere to the same extent, though juries have been seriously burdened by the requirements of the bench in such cases. But bere the administration of justice is seriously embarrassed by the very evil which Lord Camp- bell’s bill is designed to remedy. It is notorious that one or two impracticable men upon & jury can defeat almost indefinitely the ends of justice, and it is not without some reason that the opinion prevails thet one or two such men are sometimes cungeicd into the jury box for the special purpose of deieating justice. Nothing has done more to unsettie the popular confidence in the jury system than this shene of it. It is notorious that cases have resulted, not once only but oftever, In a disagreement of the jury, on the merits of which there really could be no difference of opinion, and in which the evidence was positively irresistible. There are other cases, doubtless, where the evidence 80 conflicting that intelligent and reasonable men may well hesitate at prououncing a verdict, and there may be seven on one side and five on the other. With such causes as the latter, there would be no wisdom in interfering These are tona fide differences of opinion which should be re- spected, and with which the iaw or the Court sbould not interfere But for the former cases some remedy is un- doubdtedly required. From the very origin of the trial by jury it was never contemplated that the obstinacy or the iuterests of one or two men should stand in the way of the rendition of a ver- dict, whether of conviction or acquittal. It is now propused in Ragtand that the verdict of ten (or eleven) meu, out of the twelve composi the jury, shall stand as the verdict of the whole We incline to think that the :eform is a good one. and that it ts needed with us quite as much @s itis ia England.
