THE EV. = — EE Trial of Heissler and Tohaven for Robbery —After our report closed » the case of Heissler and Johuson, < with robbing Joba C. Cornell, was ther argued by Messrs. Carrington and Norris the defence, and Mr Oyid for the prosecu- » Who closed the case to the jury after speak- about half an hour. The jury, without re- ring from their box, returned a verdict of guilty indicted. And the Court adjourned. To-day, Charles Barrett and Henry Williams, plately convicted of the murder of Reeve Lewis, were brought from the jail inte court and placed in the prisoner's box. The Court ordered Charles Barrett to be placed at the bar, and asked bim if he bad anything to say why sentence of death should not be ‘upon him for the crime of which he stocd con- victed . The prisoner replied : “Yes, sir; Officer Carrico has sworn my life away falsely. He testificd at the jail that he saw me ch Entwistie by the collar and shoot him, and that he didn’t know who fired the rest of the shots. And afterwards, at court, be swore ditfer- ently, after finding how Entwistle was going to swear. He has sworn iS away falsely, and 1am innocent of the murder” The Court thea said: You have been convict- ed of one of the greatest crimes against society known to jts laws The life of a fellow being bas been destroyed by your hand. A trial of en- tire fairness, and a defence conducted by the counsel of your selection with the most vigilant zeal and distinguished ability and learning, has resulted in a verdict of which the legal conse- quence to you is the penalty of death No con- troverted questions of law were made on the trial, it belay too plain for dispute that whoever perpetrated the crime with which you were charged was guilty of murder. leaving as the only ground of contest the identification of the individuals who committed the deed You, and Your associate, convicted of the lesser offence of manslaughter, the jury have said by their ver- dict, are those individuals. Generally speaking, @ motive, however bad, may be seen that prompts to bomicide, but in chis instance there is no per- ceivable cause for the terrible act You, and your companion, were entire strangers to the de- ceased aud bis companion; not a word of any sort—not even a gésture—on either side, pre- ceeded the outbreak, but in utter wantonness of fatal mischief, wounds were inflicted which caused death. Until recently such crimex were unheard of, and have been generated in vicious associations and nocturnal clubs of wiid, idle, and dissipated young men, who sally out from their midnight haunts inflamed by liquor, to find their way to the penitentiary aud iguomin- ious deaths. You were deeply intoxicated on the 27th of March at nizht, but for which I probably would not now be performing a most unpleaxant official duty. [trust that others may protit by your sad fate, and that you will devote ali the time that Temains to you ou earth to reflections on the past, to repentance real and heart-feit for its misdeeds, to prayers to the Great Judge for pardon of them, and to preparation to meet him in Heaven | would advise you to send for one or more clergy- men of the religious persuasion to which you belong. Any of the ministers of the Gospel wil instract and assist you in vour eiforts tu secure the fevor of the Almighty, will a: d you the consolations of religion, and will so yuide and second your own exertions, ax, | hope, to give them success. It is now the painfal duty of the Court to Ppro- nounce the sentence of the law upon you for the crime whereof you stand convicted) The sen- tence is, that you be hanged by the neck until you are dead, and that the Marshal for the Dis- trict of Columbia do, on peril of what may fall thereon, cause execution of this judgment to be Made and done upon you, on the twenty-second @ay of Octobet next, between the hours of nine (9) e’ clock in the forenoon and twelve (12) o'clock at noon of ibe same day; that you be now taken from hence to the jail of Washington county, in the District of Columbia, from whence you cam~, there to be closely kept untii the day of execu- tion, and on that day of execution appointed ax aforesaid, you are to be takeu to the place of exe- cutiop, according to the provisions of the act of Congress of 2o:h January, 1753, there to be banged as aforesaid, until you are dead | prayAlmighty God to heve mercy on your soul! Henry Williams was then placed at the bar aud sentenced to sight years imprisonment in the penitentiary ‘They were remanded to the jail Augustus Heissier and George Johnson were then brought inte Court The Judze replied at length upen the argu- ments of the counsel for the defence on motion fora new trial of George Johnson, overruling the motion. Heissler and Jobnson were then placed at the bar, and sentenced each to eight years in the penitentiary under the conviction for the murder ef Stoops, and reven years each inthe penitea- tiary for the rubbery of Jobn C. Cornell, making fifteen years in all for both prisoners ‘The prisoners were then remanded to the jail, Heissler betraying great indiff-rence as to the sentence, and smiling, as he left the Court. Jobn- Sou seemed to take the sentence hard. Jobn Roach and Thomas Hanaban were then — upon trial for an assault aod battery upon obn C. Magruder with intent to kill. The cart was found, and the ac- gave band i7 citizens have been talking over the Snancial con- dition of the Corporation ; and the City Councils also have been surmising bow matters stand The citizens seem to be entirely in the dark on the subject, and the City Fathers appear to be but little better informed. All appears to be guess work at present, and it will require consid erable time and labor to ascertain the exact truth: Mr. Councilman Orme, at an early meeting of the Council Board, asserted that the floating debt of the C. At the next meeti he corrected his statement, then was that it would be over comfort, Indeed, for oe fori Gtinene who are looking with con- siderabie anxiety to the present Councils for the ze of acts for improvements really needed. ‘be announcement was astounding, coming as it aid fron: 2 gentieman whe has always been a close observer of the Corporation's Snanctal con- tion. This ts certainly a large balance agains: our tax-paying citizens—a heavy load to carry, if net to Tift. But the query is, May not that be’ above the mark? Can any one show that it is? If 80, let him speak out. The tax payers want to know the truth. They are the parties aifected by this enormous debt, and now fs the time for them to know the truth, before any considerable amount is added to the liabilities The appropriation bill for general expenses of the Corporation adds to this sum about 263,010. The aa ee of the special police, under the act supplemental to the police bill, be Mayor Ber- ret, adds another item of 921,000. ‘The amount of the public-school expenses last year was about $25,000; about $9,000 of which is paid by the scuvol fund and school tax; leaving $16,000 for tue city to raise bytaxation. If the public xchool« ate not improved, and the total expenses amount to no more in this tban in the last year, there will still appear the amount of $16,000 agaluat the city on that account. Then the account will look as follows. Viz: Mr. Orme’s calculation. (floating debt). General appropriations... As the assessment this year stands for five years, it being the geneial assessment, property owners will hardly relish the scheme, especially when they remember that property bas not increased in value this year. ‘Phe S24 00U invested in «pe- cial police being evidently already not needed to be xo invested, many around us ate clamorous to have the Councils repeal the Jaw; while nota few are demanding that ail improvements be suspended during the present year.
