Whereupon the Court decided that the evi- dence must conform to the inatters at issue, and that the questions were not evidence. The witness then stated that Carrico came to bim with the information the Saturday evening following the occurrence; that the parties were arcested on that night, and that afterwards Car- Tieo was put in jail for contumacy in refusing to testify; the warrant for the arrest was made on the aiiidavit of Mc. Mr. Maury, for the defence, stat to the court that he desired to read in evidence the advertisement published in a newspaper, otfering a reward for information which woul, Jead to the arrest and conviction of the arties whe bad made the attack on the two xeutlemen, Messe. Lewis and Entwistle, soon after its occur. renee, to show that the r tien toCapt Goddard, was ve the reward; as Carrico had, so the counsel contended, stated in bis evidence yester- day that be koew the reward had been offered. Mr. Cross objected; stating that the witness Lad not so stated in bis evidence. and there was ny evidence to show that the witness had seen the advertixement, but that be bad stated that he afterwards heard of the fact that a reward had been olftered. Tur Ga-stion was argued by the counsel on beth sides Whereupon the court decided that, under the peculiar el comstances, the advertisement Was admissibt videuee, giving the reasons fvertisemeot iu question was therefore the jury by Mr. Chilton Mr. Ould then called, as rebatting evidence for he proserution— WH Thompson, sworn—ts a policeman at embers the night on which the 3 owas calming at the {, Ubiy Was between 12 aud ht the street Lamps were Lit; Kry size. and about thirty-five ity yards apart, when they are Lita person other side can see very well and pliioly ows the street; witness don't know at what cise titue the vceurrenee took place W. 4. The case was bere closed on both sides, as far as the giving of evidence was concerned. No instructions were asked on either side, and Mr. Cross pri to address the jury on the part of the prosecution. He began’ by statin; that, wlthough he might, perhaps, not be expect- ed to display the oratorical powers and forcible reasoning of his absent friend, the District At- torney, yet he would at least imitate him in his proverbial brevity. Mr. C. then went on to recite the evidence that had been adduced, and to comment upon it. ‘There was little in the evidence to be disputed, and no perplexing law points to be explained; and the only uestion for the jury to consider would be the Identification of the prisoners; and tbat wax clearly done by the witness Carrico There could be no donbt that this was a case of murder, clearly proven and indisputable. After going over the case, and alluding to the material points which had been brought out in the evidence, Mr. Croxx commented with severity upon the cowardly conduct of the witness Car- rico, on the night of the homicide; stating that there was no denying the fact that his conduct was unworthy and unbecoming a man and an officer, on the occasion; ke that circumstance could not lessen the cred bility that should be attached to hisevidence. His reason for conceal- ing the matter until he bad ascertained that the perpetrators could both be arrested at one time, was obvious His life would have been in peril Lad be communicated the information, according to his expressed belief, sooner than be did. Mr. Cross concluded by saying to the jury that all that Le asked of thein was to consider the evi- dence which had been given, carefully, and dis- passionately, and be had such entire contidence in their characters as jurymen as to belleve that par verdics would be given hones:ly and fairly His remarks occupied about one hour, after which the jury took a recess. After taking a short recess, the jor the box, and Mr. Maury commenced his opening for the defence. He began by commenting upon the fact that the prosecution in the nding case presented the unusual spectaele to the juryof a case of a murder In which they relied entirely — the evideuce of one witness, upon whose character for credibility they had conceived it necessary to expend all their ingenuity in order to bolster it up and sus’nin it; and that witness Was a lian Whose conduct on the oceasion now being inguired into, the learned counsel had characterized in terms which it richly deserved. He then went on to comment upon the evi- dence, which he did with great legal acumen, and was «peaking when our report closed, came into First District Hien Scnocr—Femals De partencnt.—The examination of this school took place at the school room, corner of Pennsyl- vania avenue and Nineteenth street yesterday afternoon.
